RESOLUTION NO. 1245
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD APPOINTING
PERSON TO ACT AS ENGINEER OF WORK, DESIGNATING ENGINEER OF WORK, AS THE PERSON RESPONSIBLE FOR PREPARATION
MENT DIAGRAMS, ASSESSMENT ROLL AND WARRANT; DESIGNATING THE ENGINEER OF
OF THE ENGINEERING DOCUMENTS, ASSESS-
WORK TO SUPERVISE ALL WORK; APPBINT- TING ENGINEER OF WORK AS THE SUPERIN- TENDENT OF STREETS AND FIXING, COMPEN- 1 SATION FOR SERVICES.

RESOLVED by the City Council of the City of Carlsbad that
WAYHE P. LILL be, and he is hereby appointed Engineer of Work for
the proposed doing of all necessary engineering work and exercising 1
all of the functions provided for the office of Engineer of Work 1
and Superintendent of Streets in the "'Improvement Act of 1911" in
connection with the improvement work in the City of Carlsbad, and 1

to be known as the improvement of Adams Street, Chinquapin Avenue, 1 '
Harrison Street, Highland Drive, Hillside Drive, Hoover Street, 1

and blue prints, including any and all such maps necessary and in- 1
BE IT FURTHER RESOLVED that said lnlayne P. Lill shall act as
Engineer of Work and Superintendent of Streets and is hereby employ4 1
ed and appointed to furnish all surveys, original drawings, maps 1

cident to the rights of way contemplated in the improvement work
herein involved; all plans and specifications, all inspection work,
preparation of assessment rolls, assessment diagram and warrant and
any other services which shall be required from the Engineer
of Work and/or Superintendent of Streets under the provisions of
the "Improvement Act of 1911"; and
BE IT FURTHER RESOLVED that said Wayne P. Lill, is hereby ap-
pointed as the person to supervise, inspect, and accept in behalf

and completion of such work and improvements.
BE IT FURTHER RESOLVED that said Wayne P. Lill, Engineer of
Work, is hereby appointed to act in the names place and stead
of the "Superintendent of Streets", as such name and title appears
under the provisions of the "Improvement Act of 1911".
BE IT FURTHER RESOLVED that for such services that the said
kiAYNE P. LILL, acting in his capacity as Engineer of Work and Supev
intendent of Streets, shall receive as and for his compensation fol
the services so specified, and as provided by law3 the following
compensation, which shall consist of the following sums of money;
Eight per cent (8%) of the contract price for
engineering services.
Two per cent (2%) of the contract price for preparation
Assessment, Assessment Roll
Warrant.

BE IT FURTHER RESOLVED that of the compensation so allowed to
said WAYNE P. LILL shall be paid to the General Fund of the City
of Carlsbad.
BE IT FURTHER RESOLVED that said sum shall be based upon the
contract price without incidentals, and in the event the proposed
proceedings herein contemplated shall be defeated or for any reason
fai,l of consummations the said WAYNE P. LILL shall be paid a reason
able compensation for his services which he has performed, and
which in no event shall be less than $100.00.
BE IT FURTHER RESOLVED that the fees herein provided to be
paid to the said Engineer shall be payable as follows:
(a) Three-fourths (314th) of the Engineering fee upon awarding and signing the contract for the work.
(b) The balance of said Engineering fees and other fees herein provided for, upon the confirmation of the assessment and delivery of the Warrant.

PASSED, APPROVED AND ADOPTED by the City Council of the City
of Carlsbad at a regular meeting held on the 15th day of March,
1966, by the following vote, to wit:
AYES: Cmn. Dunne, Neiswender, Atk
NOES: None.
