RESOLUTION NO. 1287
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD APPOINTING PERSON TO ACT AS ENGINEER OF WORK, DESIGNATING ENGINEER OF NORK AS THE PERSON RESPONSIBLE FOR PREPARATION
MENT DIAGRAMS, ASSESSMENT ROLL AND WARRANT; DESIGNATING THE ENGINEER OF
OF THE ENGINEERING DOCUMENTS, ASSESS-
WORK TO SUPERVISE ALL WORK; APPOINT- ING ENGINEER OF WORK AS THE SUPERIN- TENDENT OF STREETS AND FIXING COMPEN-
- SATION FOR SERVICES.
(Proposed Assessment District No. 3-1966)
RESOLVED by the City Council of the City of Carlsbad that
WAYNE P. LILL be, and he is hereby appointed Engineer of Work for
the proposed doing of all necessary engineering work and excercising
all of the functions provided for the office of Engineer of Work and
Superintendent of Streets in the "Improvement Act of 1911" in con-
nection with the improvement work i the City of Carlsbad, and to
be known as the improvement of James Drive from Buena Vista Way to
its northerly terminus in Lot 11, Wilsonia Tract, Map No. 2169.
BE IT FURTHER RESOLVED that said Gdayne P. Lill shall act as
Engineer of Work and Superintendent of Streets and is hereby employ-
ed and appointed to furnish all surveys, original drawings, maps
and blue prints, including any and all such maps necessary and in-
cident to the rights of way contemplated in the improvement work
herein involved; all plans and specifications, all inspection work,
preparation of assessment rolls, assessment diagram and warrant and
any and all other services which shall be required from the Engineer
of Work and/or Superintendent of Streets under the provisions of the
"Improvement Act of 1911"; and
BE IT FURTHER RESOLVED that said Wayne P. Lill is hereby ap-
pointed as the person to supervise, inspect, and accept in behal
the City of Carlsbad the installation, construction, performance and
completion of such work and improvements.
BE IT FURTHER RESOLVED that said Wayne P. Lill, Engineer of

Work, is hereby appointed to act in the name, plac and stead of
the "Superintendent of Streets", as such name and title appears un-
der the provisions of the Improvement Act of 1911.
BE IT FURTHER RESOLVED that for such services that the said
MAYNE P. LILL, acting in his capacity as Engineer of Work and Super-
intendent of Streets, shall receive as and for his compensation for
the services so specified, and as provided by law, the following
compensation, which shall consist of the following sums of money:
(a) Twelve and one half percent (12 1/2%) of the contract prict for engineering services.
(b) One and one half percent ( 1 1/2%) of the contract price for preparation of Assessment, Assessment Roll, Assessment Diagram, and bdarrant.
BE IT FURTHER RESOLVED that of the compen ation so allowed to
said Caayne P. Lill as provided by law, shall be payable to the Gen-
eral Fund of the City of Carlsbad.
BE IT FURTHER RESOLVED that said sum shall be based upon the
contract price without incidentals, and in the event the proposed
proceedings herein contemplated shall be defeated or for any reason
fail of consummation, the said Wayne P. Lill shall be paid a reason-
able compensation for his services which he has performed, and whic!
in no event shall be less than $100.00.
BE IT FURTHER RESOLVED that the fees herein provided to be paic
to the said Engineer shall be payable as follows:
(a) Three-fourths (3/4ths) of the Engineering fee upon awardin!
(b) The balance of said Engineering fee, and other fees herein
and signing of contract for the work.

PASSED, APPROVED AND ADOPTED by the City Council of the City
of Carlsbad at a regular meeting held on the 19th day of July, 1966
by the following vote, to wit:
AYES: Councilmen Northing, Atkinson, Bunne and Jardine
NOES: Coranci lman Neiswender
