HomeMy WebLinkAbout1966-08-02; City Council; Resolution 1294B RESOLUTION NQe 1294 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAI) CORRECTING RESOLUTION NO, 1179 TO PROPERLY REFLECT ACTION OF CITY COUNCIL REGARDING WAIVER QF' INVESTIGATION PRQCEEDINGS UNDER THE "Special Assessment'Investigatign, Limitation and Majority Protest Act sf 1933", (Assessment District 4- 196 4) Be it resolved by the City Council. of the City of Carlsbad as follows: I, That it does hereby find and determine that City Council Resolution No, 1179 should be corrected to reflect the action of the City Council in waiving the provisions of the "Special Assessment Investigation, Limitation and Majority Protest Act of 11931*f on September 7, 1965, ZC That the body oE Resolution No, 11/79 is hereby amended to read as follows: WMEREAS, on the 30th day of August, 1965, a petition was filed with the City Clerk of the City OS Carlsbad, said petition bearing the date August 30, 1965, wherein the petitioners requested that the City Council initiate proceedings to have the following improvement done in the City of Carlsbad: Installation of ornamental street lighting standards, lastallation a€ underground electrical system and other necessary and incidental apgurtenrances; said imprwements to be installed upon portions oE the following listed streets: ELM AVENUE frorn its intersection with the A,T* G S~FI Railroad Company easterly right-of-way line tQ its intersection with California Interstate No, 5 Freeway westerly right-of-way line, CEDAR AVENUE BEECH AVENUE STATE STREET I Erom its intersection with Carlsbad Boulevard tQ its intersection with Mope Avenue from its intersection with the AaT, 6 S,F, Railroad Company easterly right-of-way line to its intersection with State Street, from its intersection with State Street to a point 192a62 feet east of said i?lterSectiQn, from its intersection with Elm Avenue to its intersection with Laguna Drive, ' 4, % d I i ! 1( 1: 1: 1: 3L If le 1'; 1E 1: 2c 21 22 2 z 24 25 26 27 28 29 30 31 32 ROOSEVELT STREET Erogx its intersection with Elm Avenue to its intersectian with Grand Avenue, MADXSON STREET JEFFERSON STREET WARDING STREET and from its intersection with Elm Avenue to its intersection with Grand Avenue from its intersection with Elm Avenue to its intersection with Grand Avenue, from its intersection with Elm Avenue to its intersection with Grand Avenuer WHEREAS, all of the owners of more than sixty per cant (60%) in area of the property subject to assessment for said proposed improvements have signed and filed with the City Clerk of the City of Carlsbad a written petition for said improvementi and waiver of investigation proceedings under the %pacia1 Assessment Investigatic Limitation and Majority Protest Act of l93Aett NOW, THEREFORE, the City Council of the City of Carlsbad does hereby resolve and find as follows: 1, That said petition has been filed with the Clerk of the City ;rf Carlsbad an the 30th day of Apgust, 1965, 2, That all of the owners of nore than sixty per cent (60%) in. area of the property subject to assessment: for said proposed improvements have signed and filed with the City Clerk of the :ity of Carlsbird a written petition for said improvements and waiver ,E investigation proceedings under the tfSpeciai Assessment Investiga :ion# Limitation and Majority Pratest Act of 1931"e 3, That the ''Special Assessment Investigati-ong Limitation and Iajority Protest Act of 1931" shall not apply, PASSED, APPROVED AND ADOPTED by the City Council of the City Q€ arlsbad at a regular meeting held an the 7th day of September, 965, by the following vote, to wit: AYES: Councilmen Dum@, Neiswender, Atkinson, Hughes and Jshrdina NOES: None
