RESOLUTION NO. 1325
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD OVERRULING ALL
ING THE ASSESSMENT AND CONFIRMING PROTESTS ON THE ASSESSMENT, CONFIRM-
(improvement of Acacia Avenue) A.D. NO. 3-1965
MHEREAS, on the 4th day of October, 1966, the Engineer of
Work filed with the City Clerk of the City of Carlsbad his assess-
ment to represent the cost and expense of the work d improve-
ment for the work done upon these streets and properties in the
City of Carlsbad, ordered by Resolution No. 1234 of the City of
Carlsbad, and as said work and improvement was done by T. B.
Penick & Sons, Inc., said work being more
ed in Resolution of Intention No. 1219; and

WHEREAS, the City Clerk of the City of Carlsbad has duly
given notice of publication, posting, and mailing in the time
manner provided by law of th2 filing of said assessment and of
the time of hearing thereon; and
WHEREAS, the City Council of the City of Carlsbad has taken
said assessment under consideration and has received all oral and I
documentary evidenceg and any and all p
assessment, p roceedi ngs here tofore had, the proper completion
of the work and improvement for which t ssessment has been
issued.

NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of
the City of Carlsbad that a71 protests, if any, as the same appear
upon the minutes of the City Council of the City of Carlsbad at the
date set for hearing be, and they are hereby overruled.
BE IT FURTHER RESOLVED that 1 proceedings prior to the date
of hearing, relating to said asse merit, and all acts and determin-
ations of all officers and employees of the City of Carlsbad, in
e are hereby ratified , relation to said assessment be, and th
and confirmed.

BE IT FURTHER RESOLVED that said assessment and the diagram
and warrant attached thereto be, and the same is hereby confirmed
by the City Council of the City of Carlsbad.
BE IT FURTHER RESOLVED that the Engineer of Work is hereby
ordered to deliver said warrant, assessment and diagram to T. B.
Penick & Sons, Inc., the Contractor, forthwith upon the payment
by hin; of the balance of the incidental expenses due thereon, and
the warrant shall bear the date of this order.
PASSED, APPROVED AND ADOPTED by the City Council of the City
of Carlsbad at a regular meeting of the City Council held on the
1st day of November, 1956, by the following vote to wit:
