LILL be, and he is hereby appointed Engineer of Work for the pro- osed doing of a1 1 ne ces s ary engineering work and exerci s i ng a1 1 of he functions provided for the. office of Engineer of Work and Super- ntendent of Streets in the "Improvement Act of 1911" in connection ith the improvement work in the City of Carlsbad, and to be known 5 the improvement of Jefferson Street, Elm Avenue to a point 214 eet plus '0 r minus, .north of the intersection of L as F1 ores rand Avenue, Jefferson Street to Vi 11 age Homes Subdivision Drive; nit No. 1; Laguna Drive, Jefferson Street to Village Homes Subdivi- ion, Unit No. 1; Knowles Avenue, Buena Place, Buena Vista Way and as Flores Drive at their intersections with Jefferson Street; and BE IT FURTHER RESOLVED that said WAYNE P. LILL shall act as ngineer of Work and Superintendent of Streets and is hereby employ- d and appointed to furnish all surveys, original drawings, maps nd blue prints, including any and all such maps necessary and in- ident to the rights of way comtemplated in the improvement work erein involved; all plans and specifications, all inspection work, reparation of assessment rolls, assessment diagram and warrant and ny and all other services which shall be required from the Engineer f Work and/or Superintendent of Streets under the provi s i ons of the Improvement Act of 1911"; and BE IT FURTHER RESOLVED that for such services that the said AYN.E P. LILL acting in his capacity as City Engineer of the City of arlsbad shall receive as and for his compensation for the services 3 /I I 1 2 (1, so specified, and as p,rovided by law, the following compensation, which compensation shall be payable to the General Fund of the City e sbad, and shall consist of the following sums of "money: 1. Eight per cent (8%) of the contract price for engineering services. Two per cent (2%) of the cont Assessment, Assessment Roll, Assessment Diagram, and Warrant. 5 6 7 2. BE IT FURTHER RESOLVED that said sum shall be based upon the contract price without incidentals; and in the event the proposed proceedings herein comtemplated shall be defeated or for any reason lo fail of consumption, the said WAYN.E P. LILL of the City of Carlsbad l1 shall not receive any compensation; and 12 ct price for preparation of BE IT FURTHER RESOLVED that the fees hereinabove provided to be paid to the said Engineer shall be payable as follows: 14 15 1. Three-fourths (3/4ths) of the Engine ing fee upon awarding and signing of contract for the work. 16 17 18 II I 2. The balance of said Engineering fee, and other fees herein provided for, upon the confirmation of the Assessment and delivery of the Warrant. PASSED, APPROVED AND ADOPTED by the City Council of the City of Carlsbad at an adjourned regular meeting held on December 20, 7966, by the following vote, to wit: AYES: NOES: None. ABSENT: None. Cmn. Northing, Neiswender, Atkinson, Dunne and Jardine.
