HomeMy WebLinkAbout1966-12-20; City Council; Resolution 13488*.. 1 2 3 4 5 6 7 8 9 10 12 12 13 14 15 16 17 18 19 20 21 22 2 3 24 25 26 27 28 29 30 31 32 I 1 i I Q I RESOLUTION NO. 1348 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DECLARING ITS INTENTION TO ORDER CERTAIN STREET IMPROVEMENTS AND APPURTENANCES AND APPURTENANT WORK IN SAID CITY; DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT; DESCRIBING THE DISTRICT TO BE BENEFITED BY SAID WORK AND TO BE ASSESSED TO PAY THE COST AND EXPENSE THEREOF; DETERMINING THAT BONDS SHALL BE ISSUED TO REPRESENT ASSESSMEETS TO BE LEVIED; AND FIXING THE TIME AND PLACE FOR HEARING PROTESTS AND OBJECTIONS TO SAID MORK OR THE EXTENT OF THE DISTRICT TO BE ASSESSED, OR BOTH, AND GIVING NOTICE THEREOF. (Proposed Assessment District No. 2-1965) Jefferson Street, et a1 The City Council of the City of Carlsbad, California, DOES HEREBY ERMINE AND ORDER as follows: Section 1. That the public interest and convenience require and that it is the intention of the City Council of said City of Carlsbad to order the following work to be done or improvements to be made in the said City of Carlsbad, to wit: /- I i. The construction of certain street improvements and appurtenances and appurtenant work on Jefferson Street and proposed easements and rights of way in said City, from its intersection with Elm Avenue Northerly to a point 108.94 feet Northerly of the intersection with Las Flores Drive, be cleared, grubbed and graded: that the subgrade be prepared and paved with two and one half inches (2%") of asphaltic concrete -surface course with chip seal coat laid upon six inches (6") of compacted base material; six inches (6") asphaltic concrete berm; two inches (2") road oil mix surface course laid upon compacted native material: Portland 5 Cement con,crete curb and gutter, sidewalks, depressed curb sections, driveway approaches, gravity head- wall, reinforced concrete curb inlets, reinforced concrete drainage or transite conduit, precast re- inforced concrete drainage manhole structures, cross gutters and spandrels, steps, concrete, pipe lugs: corrugated metal pipe conduit with pipe anchors: rip rap, galvanized pipe handrail: embank- ment slope planting: four inch (4") and six inch (6") vitrified clay pipe sewer laterals: reconstruc- tion of block wall to be constructed therein: adjust- ing of existing sewer manholes to grade: that portion of Grand Avenue and proposed rights of way in said City, from a point forty faur feet (44') Westerly of its intersection with Jefferson Street to a point thirty eight feet (38') Easterly of its intersection with Hope Avenue, be cleared, grubbed ardgraded: that the subgrade be prepared and paved with two and one half inches (24") of asphaltic concrete surface course with chip seal coat laid upon six inches (6") of compacted base material: six inches (6") asphaltic concrete berm and asphal- tic concrete sidewalk; two inches (2") road oil mix surface course laid upon compacted native material; Portland Cement concrete curb and gutter, sidewalks, driveway approaches, depressed curb sections, span- drels and cross gutters, steps, reinforced concrete alley approaches be constructed therein: adjustment of existing sewer manholes to grade: that portion of Hope Avenue and proposed rights of way in said City, from its intersection withGrand Avenue to its intersection with Home Street; be cleared and graded; that the subgrade be prepared and paved with two inches (2") of asphaltic concrete surface course with chip seal coat laid upon four inches (4") of compacted base material: Portland Cement concrete curb and gutter, sidewalks, driveway approaches, depressed curb sections, span- drels and cross gutters, steps, be constructed therein: adjustment of existing sewer manholes to grade: that portion of Home Street and proposed rights of way in said City, from its intersection with Jeff- erson Street to its intersection with the Westerly boundary of Village Homes Subdivision Unit No. 1, Map No. 4032, be cleared, grubbed and graded: that the subgrade be prepared and paved with two inches (2") of asphaltic concrete surface course with chip seal coat laid upon four inches (4") of compacted base material: Portland Cement concrete curb and gutter, sidewalks, driveway approaches, depressed curb sections, spandrels and cross gutters, steps: four inch (4") vitrified clay pipe sewer laterals be constructed therein; adjustment of existing sewer manholes to grade; that portion of Arbuckle Place, in said City, from its intersection with Jefferson Street to a point forty four feet (44') Westerly, be cleared, grubbed and graded; that the subgrade be prepared and paved with two inches (2") of asphaltic concrete surface course with chip seal coat laid upon four inches (4") of compacted base material: Portland Cement concrete curb and gutter, sidewalks, spandrels; and two inches (2") road oil mix surface course laid upon compacted native material constructed therein; that portion of Laguna Drive and proposed rights of way, in said City, from its intersection with Jefferson Street to a point forty four feet (44') Westerly, that Northerly one half portion of Laguna Drive and proposed rights of way, in said City, from its intersection with Jefferson Street to a point fifty three feet (53') Easterly of its intersection with Davis Avenue; and that -Southerly one half portion of Laguna Drive and proposed rights of way, in said City, from its intersection with Jefferson Street to its intersection with the West- erly boundary of Village Homes Subdivision Unit No. 1, Map No. 4032, all be cleared, grubbed and graded; that the subgrade be prepared and paved with two inches (2") of asphaltic concrete surface course with chip seal coat laid upon four inches (4") Of - 3- i .. 0 compacted base material: two inches (2") of road oil mix surface course laid upon compacted native mater- ial: Portland Cement concrete curb and gutter, side- walks, driveway approaches, depressed curb section, reinforced concrete curb inlets, reinforced concree drainage or transite conduit, precast reinforced concrete drainage manholes, cross gutters and span- . drels: four inch (4") vitrified clay pipe sewer lat- erals; the reconstruction of block wall be construc- ted therein: adjustment of existing sewer manholes to grade: that portion of Knowles Avenue and proposed rights of way, in said City, from its intersection with Jeffer- son Street to a point forty four and four hundreths feet (44.04') Easterly, be cleared, grubbed and gra- ded: that the subgrade be prepared and paved with two inches (2") of asphaltic concrete surface course with chip seal coat laid upon four inches (4") com- pacted base material: two inches (2") road oil mix surface course laid upon compacted native material: Portland Cement concrete curb and gutter, sidewalks, spandrels be constructed therein: that portion of Buena Place and proposed rights of way, in said City, from its intersection with Jeff- erson Street to a point forty four and four hundreths feet (44.04') Easterly, be cleared, grubbed and gra- ded: that the subgrade be prepared for the construc- tion of Portland Cement concrete curb and gutter and spandrel (reconstruction), sidewalks, and depressed driveway approaches be constructed therein; that portion of Buena Vista Avenue and proposed right of way, in said City, from its intersection with Jeffersn Street to a point forty four and four hundreths feet (44.04') Easterly, be cleared, grubbed and graded: that the subgrade be prepared and paved with two inches (2") of asphaltic concrete surface course with chip seal coat laid upon four inches (4") of compacted base material: two inches (2") road oil mix surface course laid upon compacted native material: Portland Cement concrete curb and gutter, spandrel, sidewalks be constructed therein; that portion of Las Flores Drive and proposed rights of way, in said City, from its intersection with Jefferson Street to a point fifty and twenty eight hundreths feet (50 . 28 ') Easterly, be cleared, grubbed and graded: that the subgrade be prepared i -4- I c and paved with two inches (2") of asphaltic concrete surface course with chip seal coat laid upon four inches (4") of compacted base material; six inches (6") asphaltic concrete berm; two inches (2") road oil mix surface course laid upon compacted native material; Portland Cement concrete curb and gutter, spandrel, sidewalks be constructed therein; that the said work herein before described shall be done to the official grades shown with the exact nature, extent and location of said improvements to be in accordance with detailed plans on file with the City Clerk of the City of Carlsbad, containing sixteen (16) sheets entitled, "Construction Plans for the improvement of Jefferson Street, et al, Project No. 5-4, Drawing No. 146-8, Assessment District No. 2-1965." .. .. .I' .. - 5-- of the dimensions, at the places and in the manner shown on the plans (which include profiles and detailed drawings) for said work, des- l9 20 21 22 I I I city, and reference is hereby made to said plans and specifications for the full and detailed description of said proposed work and for a description of the grades at which said work is to be done. Section 3. That in the opinion of this City Council the said contemplated work is of more than local or ordinary public benefit ~ and this City Council hereby makes the expense of said work charge- ~ able upon a district, which district this City Council hereby de- clares to be the district benefited by said work and to be assessed to pay the cost and expense thereof. For a description of said district reference is hereby made to a plat or map of said district heretofore approved by this City Council, on file in said office of the City Clerk and designated "Assessment District No. 2-1965 Map", which map or plat indicates by a boundary line the extent of the territory included in the said proposed district and shall govern for all details as to the extent of said assessment district. Section 4. That serial bonds bearing interest at the rate of six percent (6%) per annum shall be issued to represent each assess- ment of fifty dollars ($50.00) or over remaining unpaid for thirty (30) days after the date of recordation of the warrant. That the said proposed work i to be done under and proceedings therefore are to be under and pursuant to the said xten and must be delivered to the said City Clerk not later than the hour herein set for hearing protests or objection All protests and objections must be in writing and must contain a description of the property in which each signer thereof is interested, sufficient to identify the same and shall be delivered to and filed with the City Clerk, City of Carlsbad at 2960 Pi0 Pic0 Dri ve, Carlsbad, California. Section 7. The CARLSBAD JOURNAL, a newspaper of general circu- lation published and circulated in the said City of Carlsbad and in the County of San Diego, California, is hereby selected as the d over a period ending nine (9) years from the second day of January next succeeding the next September 1st follow- ing their date. Said bonds are to be issued pursuant to and as 1 provided in the Improvement Act of 1911, Division 7 of the Streets I and Highways Code of the State of California, and pursuant to the provisions of Section 6464 of said Division 7, this City Council hereby elects and determines that the redemption provisions of said bonds shall provide for a premium of five percent (5%) of the 1: 14 15 16 17 18 19 20 21 22 2 3 24 25 26 27 28 29 30 31 32 - 7- /I I 1 2 newspaper in which this resolution of intention shall be made. The said City Clerk is hereby directed to certify to the adoption of manner provided by law. Section 8. The said City Clerk is hereby directed to mail notices of the adoption of this resolution as provided in said Im- 7 8 g 10 11 12 13. 14 provement Act of 1911, postage prepaid, to all persons owning real property which is proposed to be assessed to pay any part of the cost of said work, whose names and addresses appear on the last equalized assessment roll or as known to the said City Clerk, in- cluding the mailing of such notices to every owner of property assessed by the State under Section 14 of Article XI11 of the Con- stitution at the address thereof shown on the last board roll trans- mitted to the County Auditor. 15 25 16 17 ABSENT: None. 18 19 20 21 22 23 24 Section 9. The Engineer of Work of the said City of Carlsbad is hereby directed to cause to be conspicuously posted along the line of the contemplated work and on all open streets within the said assessment district notices of the passage of this resolution of intention in the time, form and manner provided by law. PASSED, APPROVED AND ADOPTED at a regular meeting of the Citj Council of the City of Carlsbad held on the 20th day of December, 1966, by the following vote, to wit: AYES: Cmn.
