HomeMy WebLinkAbout1967-02-21; City Council; Resolution 1384RESOLUTION No. 1384 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD AUTHORIZING AND DIRECTING CONDEMNATION OF EASEMENTS FOR PUBLIC STREET AND RIGHT OF WAY PURPOSES, efferson Street) (Assessmekf District No. 2-1965) BE IT RESOLVED by the City of Carlsbad, California, a Municipa Corporation, hereinafter referred to as CITY, by its City Council, as follows: 1, That CITY hereby finds and determines as follows: a, That there is Located in the City of Carlsbad, County of San Diego, State of California, certain real property hereinafter referred to as PROPERTY, more particularly described on Exhibit A attached hereto and by this reference incorporated herein. That the public interest and necessity requires the acquisition by CITY of easements for public street and right of way purposes in PROPERTY. That public interest and necessity requires the con- struction and completion in said easements in PROPERTE by CITY, of a public street and right of way together with appurtenances, That the taking of said easements for public street and right of way purposes in PROPERTY is necessary for said acquisition, construction, and completion. That the said use to which the said easements in PROPERTY is to be applied is a use authorized by law. b, c. de e, 2, That the City Attorney of CITY is hereby authorized and directed on behalf of CITY to acquire easements for public street and right of way purposes in PROPERTY under the Laws of Eminent Domain of the State of California. PASSED, APPROVED AND ADOPTED at a regular meeting of the .. 0 c That portion of Tract No. 3 of Laguna Mesa Tracts in the City of Carlsbad, County of San Diego, State of California, accor.ding to Map thereof No. 1719, filed in the Office of the Coanty Recorder of San Diego County June 20, 1921, more particularly described as follows: Beginning at the most Southeasterly corner of said Tract No. 3; , thence North 0'2' West along the Easterly boundary line of said Tract, which is also the Westerly boundary line of Jefferson Street (formerly Front Street), a distance of 395.91 feet to the TRUE POINT OF BEGINNING: thence continuing along the Easter- ly boundary line of said Tract, which is also the Westerly boundary line of said Jefferson Street (formerly Front Street) North 0'2' West, a distance of 204.09 feet; thence South 25O29'50" West, a distance of 226.17 feet to an intersection with a line bearing South 89'58' West from the TRUE POINT OF BEGINNING; thence North 89O58' East 97.48 feet to the TRUE POINT OF BEG- INNING.
