HomeMy WebLinkAbout1967-04-04; City Council; Resolution 1394- - .. 1 2 3 4 5 6 -7 8 9 lo 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD DECLARING THE INTENTION OF THE CITY COUNCIL TO VACATE A SE ICE ROAD IN THE CITY OF CARLSBAD BE EEN JEEFERSON STREET AND INTERSTATE 5 IN THE CITY OF CARLSBAD; AND ESTABLISHING A TIME AND PLACE FOR HEARING. The City Council of the City of Carlsbad does hereby resolve as follows: SECTION 1. The procedure for the vacation of a Service Street between Jefferson Street and Interstate 5 in the City of Carlsbad, shall be, and the same is hereby ordered to be in accord- ance with the proceedings set forth in the Street Vacation Act of 1941, contained in Sections 8300 to 8374 of the Streets and Highway Code of the State of California. SECTION 2. It is hereby resolved and declared to be the intention of the City Council to vacate that certain Service Street, more particularly described as follows: That portion of the service road of Map 2969, Palm Vista Subdivision filed March 16, 1953 in the office of the County Recorder of the County of San Diego, State of California, more particularly described as follows: Beginning at the intersection of Jefferson Street and Tamarack Avenue as shown on said Map 2969; thence North 61'20'30" East 34.00 feet along the centerline of Tamarack Avenue; thence North 28'39'45" East 84.00 feet to the TRUE POINT OF BEGINNING; thence continuing North 28'39'45" East 4.00 feet to a point on a 2Q.00 radius curve concave Northerly; thence Easterly along the arc of said curve 18.54 feet through a central angle of 53'07'34"; thence tangent to said curve North 61°20'30" East 194.96 feet to the beginning of a 30.00 foot radius curve concave Northwesterly; thence Northeasterly along the arc of said curve 35.58 feet (Record 35.59 feet) through a central angle of 67'57'41" (Record 67'58'32'') to a tangent point; thence Northeasterly, along the arc of a 50.00 foot radius curve concave Southeasterly, 62.44 feet through a central angle of 71'33'92"; thence South 14'42'46" East 69.57 feet; thence South 28'39'30" East 7.29 feet to a point on a 1949.00 footradius curve concave Northwesterly; thence Southwesterly along the arc of said curve 114.07 feet through a central angle of 3'21'12" to a tangent point; thence Southwesterly, along the arc of a 2051.00 foot radius curve concave South- easterly, 137.61 feet through a central angle of 3'50'39" to a tangent point; thence NorthMesterly along the arc of a 20.00 foot radius curve, concave Northerly 31.41 feet through a central angle of 89'59'45" to the TRUE POINT OF BEGINNING. a, 2 s SECTION 3. The City Council of the City of Carlsbad hereby 1 establishes as the date for hearing all persons interested in, or objecting to, the proposed vacation, Tuesday, May 2, 1967, at 7:30 o'clock P.M., in the Council Chambers 2960 Pi0 Pic0 Drive, Carlsbad, California. SECTION 4. The City Engineer is hereby ordered to post notic of street vacation, as herein proposed, conspicuously along the line of the street or parts thereof, proposed to be vacated, with said posting to be accomplished at least ten day of May, 1957. Such notices shall be posted not more than three hundred (300) feet apart, with at least three (3) being posted upon the street proposed to be vacated. The notices as posted shall state I the passage of this Resolution of Intention and shall state the time and place of hearing of persons inter d in, or objecting to the proposed vacati on. ) days prior to the 2nd SECTION 5. PASSED, APPROVED AND ADOPTED by the City Council of the City of Carlsbad at a regular meeting held on the 4th day of April, 1967,/ by the following vote, to wi AYES: Councilmen Worthing, Neiswender, Atkinson, Dunne and NOES: None ABSENT: None Jardine.
