RESOLUTION NO, 1413
A RESOLUTIOI\f OF THE CITY COUNCIL OF THE CITY OF . CAKLSBAD AUTIIOKIZIr\IG AND DIKECTINC; CONDENNATION OF EASEMENT FOR SEliiEK MAIN PURPOSES.
BE IT RESOLVED by the City of Carlsbad, California, a Munici- .-
pal Corporation, hereinafter referred to as CITY, by its' City
Council, as follows:
1, That CITY hereby finds and determines as follows:
A. That there is located in the-City of Carlsbad, County
of San Diego, State of California, a certain parcel of
real property, hereinafter described as PARCEL A, and
particularly described on the attachment hereto, marked
PARCEL A, which attachment is by this reference incor-
porated herein,
B. That the public interest and necessity require the
acquisition .by CITY of a perpetual'easement in, upon,
'over, and across PARCEL A for purposes of erecting, con-
structing, reconstructing, replacing, repairing, main-
taining, and operating a section of sewer main, and ,
appurtenances.
C. That the public interest and necessity require the
construction and completion in said PARCEL A, by CITY,
of a section of sewer main and appurtenances.
D, Tnat the taking of said easenent for said purposes in
said PARCEL A is necessary for said acquisition, con-
struction, and completion.
E. That said use to which said easenent in said PARCEL A is
to be applied as a use authorized by law,
2, Tnat the City Attorney of CITY is hereby authorized and
directed on behalf of CITY to acquire said perpetual easement in,
upon, over, and across PAItCEL A for purposes of erecting, constructi
reconstructing, replacing, repairing, maintaining, -,and operating, a

- section of sewer main and appurtenances, under the laws of Eminent
Domain of the State of California.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the
City Council held June 6, 1967, by the following
vote to wit:
AYES: Councilmen Worthing, Neiswender, Atkinson, Dunne and
NOES: None
ABSENT: None
