HomeMy WebLinkAbout1967-08-01; City Council; Resolution 1423.I ( I A I I t s I( 13 1: 1; 14 1: LE 2.7 1E 19 2c 21 22 23 24 25 26 27 28 29 30 31 32 0 RESOLUTION NO. 1423 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD ADOPTING PRECISE PLAN FOR SERVICE STATION ON PROPERTY LOCATED ON THE SOUTHERLY SIDE OF PALOMAR AIRPORT ROAD, BETMEEN AVENIDA ENCIMAS AND INTERSTATE 5 FREEWAY. WHEREAS, on the 11th day of July, 1967, the Planning Com- mission of the City of Carlsbad adopted Resolution No. 511, recom- mending the adoption of the precise plan for proposed C-1 Zone, a copy of which precise plan is attached hereto and marked Exhibit "B" and made a part hereof; and 'AHEREAS, on August 1, 1967, a uly advertised hearing was held by the City Council of the City of Carlsbad, at which time the City Council considered the recommendations of the Planning Commis- sion, heard all persons interested in or opposed to the adoption of the precise plan, and considered all factors relating to the adop- ti on thereof. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the precise plan, marked Exhibit "B", attached hereto, entitled 'I Precise Plan for Proposed C-1 Zone", No. PP 6704, Revised June 20, 1967, is hereby adopted as the precise plan for the area shown and described in said "Exhibit "5", subject to the following conditions and restrictions: 1. All distribution utility facilities within the boundaries of the Precise Plan shall be placed underground as required by City standards. 2. Ornamental street lighting shall be installed as requi red by City standards. 3. A final grading plan shall be submitted as re- quired by ordinance prior to issuance of building permits. 4. Location, grade and details of proposed improve- ments as indicated upon the Precise Plan will be subject to i c d 3 2 9 4 F: U 6 7 F! 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 revisions as required for improvement plans, and approval of the Plan will not imply acceptance as submitted. 5. All improvements shall comply with the standard plans and specifications of the City of Carlsbad. 6. Street paving on Avenida Encinas shall consist of two (2) inches of asphaltic concrete with stone chip seal coat laid upon four (4) inches of decomposed granite base material, all on approved subgrade. Street paving on Palomar Airport Road shall consist of three (3) inches of asphaltic concrete with stone chip seal coat laid upon six (6) inches of decomposed granite base, all on approved subgrade. 7. Type I’G” concrete curb and gutter shall be install ed in all streets. Concrete cross gutters shall be six (6) feet wide and located as required for drainage. 8. Sidewalks shall be five (5) feet minimum in width and located contiguous to the curb throughout the boundaries of the Precise Plan. 9. All required street name signs, barricades and safety devices shall be installed. 10. Drainage improvements shall include standard inlets, sidewalk underdrain structures and conduit to satisfactory glis ge points. Existing inlet in Avenida Encinas South of the Southerly boundary of the proposed C-1 Zone shall be removed and replaced with a standard inlet facility. 11. Sanitary sewers, including required manholes and appurtenances with adequate service laterals shall be con- structed as required by the City. Easements, where needed, are to be provided by the Developer. 12. Survey monuments and street trees shall be in- stalled as required by City standards. 14. Alignment, location and grades of all improve- ments shall be subject to approval of the City Engineer. Complete plans and specifications must be submitted to and approved by the City before construction of any improvement is commenced. 15. Dedication of additional rights of way as neces- sary shall be required. 16. The development of operty shall conform to all ordinances of the City of Carlsbad unless the Precise Plan Exhibit I'B" and/or the following conditions are more restrictive: (a) A minimum six foot wide landscaped area served by a water irrigation sprinkler system shall extend along the entire South and East property lines on subject property. (b) No light source shall be seen directly from the Freeway or surrounding property. A1 1 storage and/or di spl ay merchandise shall be contained within the building. (d) Sign shall be as shown on the precise plan, Exhibit I'B" except it shall not exceed eighty (80) square feet on each side and shall not be over thirty- five (35) feet in height. No additional pole signs shall be allowed. B.
