A. RESOLUTION OF THE CITY COUN IA OF THE CITY OF
reby resolve
that it does hereby approve Agreement No. 14441-A, a copy of which
is attached hereto and by this reference incorporated herein, and
does hereby horize and direct the execution thereof on behalf of
the City arlsbad b e City 74anag.er.
PASSED, APPROVED, AND ADO t a regular meeting of the
City Council held February 6 1968 by the following vote,
to wit:

AGREEMENT NO. 14441-A
THIS AGREEMENT made and entered into this
day of 19 , by and between the City of Carlsbad hereinafter referred to as "Owner" and the State of California acting by and through its Department of Public Works, Division of Highways, hereinafter referred to as "State".
WITNESSETH.
WREAS State is proposing to widen Highiqay Project Road
11-SD-5-PM 47.3-54.0 to an eight lane freeway, and
WHEREAS a portion of said work consists of the construction of an overcrossing at Chinquapin Avenue and Owner has requested that State include in said overcrossing provisions to facilitate
ttzo future 16'' water lines and to further provide access for the installation of said future facilities by installing two manholes in the bridge deck of proposed Chinquapin Avenue overcrossing.
NOW THEREFORE since the sole benefit of said manholes are
for the use of the Owner for installing and maintaining his facilities, it is hereby mutually agreed and understood between the parties hereto
- as follows :
STATE AGREES:
1. To provide for the installation of said future facilities
and to install the proposed manhole rings and covers as a part of its proposed freeway construction. '
2. To determir,e from the State contractor bid items, the actual cost of the manholes installed in the bridge deck an4 to
bill Owner after work is completed for the actual cost of the installed manhole rings and covers plus to coser State's cost of engineering and overhead. (The
total estimated cost of this work is ($880.00) eight hundred and eighty dollars .)

ixty days after receipt of claim therefore, the actual cost of instellation, including extra work, if any, plus
(10%) ten percent for State's engineering and overhead costs.
. IN WITNESS WHIBEOF, the parties hereto have caused this AGREEPENT
