RESOLUTION NO, 1485

RESOLUTION TO THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, APPOINTING ENGINEER
OF WORK AND EMPLOYING ATTORNEY IN CONNECTION
WITH ASSESSMENT DISTRICT NO, 3-1964 (JAMES
DRIVE, ET AL) e
THAT THE CITY COUNCIL OR THE CITY OF CARLSBAD,
CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That TANNER, MARQUARDT, AND ASSOCIATES,
INC., is hereby appointed as Engineer of Work to perform
all the duties prescribed for the engineer, as defined and set
forth in the Municipal Improvement Act of 1913," being Division
12 of the Streets and Highways Code of the State of California.
That Mr, Dean K. Marquardt of Tanner, Marquardt, and Associates,
Inc. is hereby designated as the authorized representative
of said company.
SECTION 2. That the compensation for said Engineer of
Work is as fixed by that certain contract and agreement by
and between the City of Carlsbad and said Engineer of Work.
SECTION 3. That Wayne P, Lill, Superintendent of
Streets of the City of Carlsbad, is to perform all the duties
of the Superintendent of Streets as set forth and designated
in said "Municipal Improvement Act of 1913. 'I
SECTION 4. That F, Mackenzie Brown, Attorney at Law,
is hereby appointed as the attorney for said proceedings for
the preparation of necessary resolutions, notices, issuance
of bond opinion, attendance at public hearings and other legal
work in connection with said assessment district. The
compensation to be paid said attorney for his services is to
be 2% of the cost of construction, said amount payable
upon issuance of bond opinion.

19 68 and that the same was passed and adopted by
the following vote, to wit:
AYES : COUNCILMEN NORTHING, NEISWENDER,
DUNNE AND JARDINE.
NOES: COUNCILMEN NONE.
ABSENT : COUNCILMEN NONE.
