RESOLIJTION NO, 1522 -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CP.RLSRRD AFFI??I,'Ib!G DECISION OF PLANNING COMF4ISSION DENYING APPLICATION FOR VARIANCE
The City Council of the City of Carlsbad does hereby resolve
as follows:
1, The action of the Planning Conmission of the City of
Carlshad denying the request of FRANK !J. ALLEY for a
variance allowing reduction of sideyard setback from
ten (10) feet to five (5) feet on property located at
the Kortheasterly corner of Carlsbad Boulevard and
Redwood Avenue is here said request for
variance is hereby denied.
2. The facts and reasons which, in the opinion of the City
Council, nalte the denial of the requested variance
necessary to carry aut the general purpose of Ordinance
No, 9060 as amended are as follows:
(a) That there are no exceptional or extraordinary
circumstances OT conditions applicable to the
property or to the intended use that do not apply
'-9 Irenerally to other property or class of use in the
same vicinity and zone;
That such variance is not necessary for the
preservation and enjoyment of a substantial
property right possessed by other property in the
sane vicinity and zone but which is denied to the
(b)
property in question;
(c) That the granting of such variance would be
materially detrimental to the public welfare and
injurious to the property and improvemnts in such
vicinity and zone in which the property is located
and
