RESOLUTION NO. 1525
A RESOLUTION OF THE CITY COUNCIL OF THE
ING EXECUTION OF AGREEMENT REGARDING USE
OF POLICE PISTOL RANGE.
CITY OF CARLSBAD AUTHORIZING AND DIRECT-
The City Council of the City of Carlsbad does hereby resolve
as follows:
1. That it does hereby authorize and direct
the Mayor to execute
of Carlsbad that certain State of California
Standard Agreement No. C-2068/69, a copy of
which is attached hereto and by this refer-
ence incorporated herein, regarding use of
the Carlsbad Police Pistol Range by members
n behalf of the City
of the Carlifornia Highway Patrol.
PASSED, APPROVED, AND ADOPTED at an adjourned regular meeting
of the City Council held June 5, 1968, by the following vote,
to wit:
AYES: Cmn. Neiswender, McComas, Jardine, and Castro
NOES: None.
ABSENT: Mayor Dunne

1. The State hereby agrees to pay for the services and matcriah at the thes, In t!x nianner and for the consideration, !wein
expressed.
2. The Contractor agrees io indemnify, defend and SRVC harmkss the StLite, its oCTcers, agcnts 2nd employees from any
2nd all claims ind losses accruing or resulting to any and all contractors, subcontractors, materiainxn, IaGorers and any
othcr person, firm or corporation furnishing or supplying work, scrviccs, materials or supplies in connection with the
performance of this contnct, and. from any and ail claims ar:d !osses accruing or resulting to any person, Erm or corporation
w?io may be injured or &"d by the Contractor in the perfc-rmance of this contract. TI?e Contractor shall provide
necessary workmnn's compensation insarance at Contractor's OKil cost and expense.
3. The parties hereto agree that the Conermor,&I zny agci1tS and employees of Contrkor, in the perfor~nancc of this
agrecnxent, shall act in an indepeadcnt capacity arid not as c5ceis or employees or agents of Stacc of California.
4. The State may terminate this agreemerit aiid be nelieved of the paymcnt of any consideration to Contiactor should
Contractor fail to perfym the covenants, herein co2tained at the time and in the tnaiiner herein provided. in the event of such
termination the Stare may proceed with the work in any manner deemed proper by State. The cost to the State sha!l %e deducted
from any sum due the Contractor under this agrcemeilt, ncd rhe La!ance, if any, shzl! be paid the Contractor upon demand.
5. This agreement is not assignable by Contractor eithcr in whole or in part. '. .
6. Time is of tbe essence of ezch and all &e provisions of this agreement, and the provisions of this agreement shall extend
to arid be binding upon and inure to the benefit of the heirs, executors, administrators, successors, and asigns of the respective
parties hereto. --
7. It is mutuzlly understood and agreed that no aiter2tioa or variation of the tei-ms of this contract shn!l be valid un!ess
madc in writing and signed by the parties hereto, and :hat no oral uridersta:idings or agreements not incorporared lierein, and
no alterzti3ns or variations of the terms hereof dess m~de in writing L:t.;;rcen the pities hereto shall Le binding on any of
the parties hereto.
