OF CARLSBAD, CALIFORNIA, ‘DECLARING ITS IN- TENTION TO ORDER THE CONSTRUCTION OF CERTAIN SANITARY SEWERS AND APPURTENANCES AND APPUR- TENANT WORK IN SAID CITY; DECLARING THE WORK TO BE OF MORE THAN LOCAL’OR ORDINARY PUBLIC FITED BY SAID MORK AND TO BE ASSESSED TO PAY THE COST ARD EXPENSE THEREOF; DETERMINING THAT BONDS SHALL BE ISSUED TO REPRESENT ASSESS- ME&TS TO BE LEVIED; AND FIXING THE TIME AND PLACE FOR HEARING PROTESTS AND OBJECTIONS TO SAID WORK OR THE EXTENT OF THE DISTRICT TO BE ASSESSED, OR BOTH, AND GIVING NOTICE THEREOF. BENEFIT; DESCRIBING THE DISTRICT TO BE BENE- (Assessment District No. 2-1966) Park Drive, Et A1 The City Council of the City of Carlsbad, California, DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows: Section 1. That the public interest and convenience require 2nd that it is the intention of the City Council of said City of zarlsbad to order the following work to be done or improvements to le made in the said City of Carlsbad, to wit: The construction of sanitary sewers appurtenances and appur- kenant work in Park Drive from Adams Street to a point 185 feet ioutherly of the intersection of Monroe Street and Park Drive; lillside Drive, from Park Drive to a point 875 feet Northerly of ;he intersection of Park Drive and Hillside Drive; Hoover Street ‘rom Highland Drive to the Southerly terminus of Hoover Street; lighland Drive from Hillside Drive to Adams Street; Adams Street ‘rom Park Drive to a point 90 feet southerly of the intersection of .ocust Avenue and Adams Street; Harrison Street from Chinquapin ,venue to a point 218 feet Westerly of the intersection of Adam treet and Harrison Street; Locust Avenue from Harrison Street to a oint 165 feet Westerly of the intersection of Adams Street and ocust Avenue; Sewer Easement in Lot 12, Block C, Re-subdivision of ortions of Tract 238 and 243, Thum Lands, Map 2103; Sewer Easement n Lots 2 and 3, Block C, Belfavista, Map 2152; Sewer Easement in ot 4, Block C, Bellavista, Map 2152; Sewer Easement in Lot 2, 3 2 3 4 5 6 7 t? 9 10 11 1% 12 14 15 16 17 1E 1s 2c 21 22 2: 24 2: 26 27 2€ 2s 3c 31 3: 0 Block D, Bellavista, Map 2152; Sewer Easement in Tract 238, Thum Lands, Map 1681, with the exact nature, extent and location of said improvement to be in accordance with detailed plans on file with the City Clerk of the City of Carlsbad, containing twenty-one (21) sheets, entitled "Construction Plans of Sanitary Sewer System in Park Drive, Locust Avenue, Harrison Street, Hillside Drive, Adams Street, Highland Qrive, Hoover Street and Sewer Easements". The estimated cost of said work or improvement, inclusive of incidental expenses, is the sum of $168,810.00. Section 2. That all the aforesaid work or improvement shall be constructed at the grades, along the lines, between the points of the dimensions, at the places and in the manner shown on the plans (which include profiles and detailed drawings) for said work!, designated "Construction Plans of Sanitary Sewer System in Park Drive, Locust Avenue, Harrison Street, Hillside Drive, Aciams Street, Highland Drive, Hoover Street and Sewer Easements", Project No. 6-12, Drawing No. 149-8, A.D. 2-1966, consisting of twenty-one (21) sheets, and in accordance with said plans and with the specifica- tions for said work, which are designated "Contract Documents and Specifications, Assessment District No. 2-1966". Said plans and specifications were heretofore approved by this City Council, and are on file in the office of the City Clerk of said City in the City Hall in said City, and reference is hereby made to said plans and specifications for the full and detailed description of said proposed work and for a description of the grades at which said work is to be done. Section 3. That in the opinion of this City Council the said contemplated work is of more than local or ordinary public benefit and this City Council hereby makes the expense of said work charge- able upon a district, which district this City Council hereby de- clares to be the district benefited by said work and to be assessed to pay the cost and expense thereof. For a description of said e 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 district, reference is hereby made to a plat or map of said district heretofore approved by this City Council, on file in said office of the City Clerk and designated "Proposed Boundaries of 2-1966 Assess- ment District, City of Carlsbad, County of San Diego, State of California", which map or plat indicates by a boundary line the extent of the territory included in the said proposed district and shall govern for all details as to the extent of said assessment district. 3 Section 4. That serial bonds bearing interest at the rate of six percent (6%) per annum shall be issued to represent each assess- ment of fifty dollars ($50.00) or over remaining unpaid for thirty (30) days after the date of recordation of the warrant. bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next September 1st follow- ing their date. provided in the Improvement Act of 1911, Division 7 of the Streets and Highway Code of the State of California, and pursuant to the provisions of Section 6464 of said Division 7. hereby elects and determines that the redemption provisions of said bonds shall provide for a premium of five percent (5%) of the un- matured principal of said bonds to be pajd as provided in said Section 6464 and in said Division 7. That the said proposed work is to be done under and proceedings therefore are to be under and pursuant to the said Improvement Act of 1911. Section 6. That notice is hereby given that the 3rd day of September, 1968, at the hour of 7:30 o'clock P.M. is the day and hour when, and the Council Chambers of this City Council in the City Hall in said City of Carlsbad is the place where, any and all persons having any protest or objection to said proposed work or to the extent of said assessment district, or to the proposed grades, may appear before the City Council of said city and show cause why -3- 1 4 F E s E s IC 11 12 12 14 1E 1E 19 2c 21 2% 23 24 25 26 27 28 29 30 31 32 said proposed work should not be carried out in accordance with this resolution of intention. Protests or object ons must be in writing and must be delivered to the said City Clerk not later than the hour herein set for hearing protests or objections. All protests and objections must be in writing and must contain a description of the property in which each signer thereof is interested, sufficient to identify the same and shall be delivered to and filed with the City Clerk, City of Carlsbad at 1200 Elm Avenue, Carlsbad, California. Section 7. The CARLSBAD JOURNAL, a newspaper of general circu- lation published and circulated in the said City of Carlsbad and in the County of San Diego, California, is hereby selected as the news- paper in which this resolution of intention shall be made. The said City Clerk is hereby directed to certify to the adoption of this resolution and to cause said resolution to be published in the manner provided by law. Section 8. The said City Clerk is hereby directed to mail notices of the adoption of this resolution as provided in said Improvement Act of 1911, postage prepaid, to all persons owning real property which is proposed to be assessed to pay any part of the cost of said work, whose names and addresses appear on the last equalized assessment roll or as known to the said City Clerk, in- cluding the mailing of such notices to every owner of property assessed by the State under Section 14 of Article XIII of the Con- stitution at the address thereof shown on the last board roll trans- mitted to the County Auditor. Section 9. The Engineer of Work of the said City of Carlsbad is hereby directed to cause to be conspicuously posted along the line of contemplated work and on all open streets within the said assessment district notices of the passage of this resolution of intention in the time, form and manner provided by law. Section 10. It is necessary as a part of the proceedings that 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 27 28 29 30 31 32 the above described easements be acquired as necessary and that the cost of the said acquisition, including incidental expenses thereof be assessed as a part of the cost of such work improvements. As 1 i used herein, the term "Work" or "Improvement" shall include acqui- sition of easement. PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council of the City of Carlsbad held on the 6th day of August, 1968, by the following vote, to wit: AYES : Councilmen Neiswender, McComas, Dunnes Jardine and NOES : None.
