PUBLIC STREET PURPOSES; VACATING SUCH PORTION OF PUBLIC RIGHT OF WAY AT TNTFRCFCTION OF CANNON Y - Be it resolved by the City Council of the City of Carlsbad as follows: 1. the proposed vacation of portions of Public Right of Way at Intersection of Cannon Road and El Arbol Drive pursuant to Resolution of Intention No. 1604 have been given as required by 1 aw. 2. That the Council did hear the evidence offered by all persons interested in said proposed street vacations, and does find from all the evidence submitted that those portions of Public Right of Way at Intersection of Cannon Road and El Arbol Drive located in the City of Carlsbad, County of San Diego, State of California, described in said Resolution of Intention, and particularly described on Exhibit A, attached hereto, and by this reference incorporated herein, are unnecessary for present or pro- spective street purposes and does hereby make this order vacating said portions of said Right of Way, provided That all publication and posting notices regarding however that the City Council does hereby determine that the public convenience and necessity require the reservatioi and exception in said portions of said Right of Way and the City Council does hereby reserve and except from said vacation, permanent easements and rights at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm r 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 r. drains and appurtenant structures, in, upon, over, and across any portion or portions of said vacated Right of Way, and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew, and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, 3 equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the transportation or distribution of electrical energy, petroleum and its products, ammonia, water, and incidental purposes, including access and the right to keep said portions of said Right of Way free from inflammable materials, and wood growth, and otherwise protect the same from all hazard, in, upon, and over said portions of said Right of Way. PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council held May 6, 1969, by the following vote, to wit: Councilmen Dunne, McComas, Neiswender, Jardine and Castro AYES: NOES: None ABSENT: None 0 I1 I EXHIBIT A All that portion of Terramar Unit No. 3, in the City of Carlsbad, County of San Diego, State of California, according to Map No. 2867, filed in the Office of the County Recorder of said County, April 23, 1952, described as follows: Beginning at the most Northeasterly point of said subdivision boundary. Said point being the end of a 477.50 foot radius curve concave Southerly, which has a central angle of 4"37'40", said point has a radial line which bears South 10°39'00" East; Thence'along said radial line South 10°39'00'' East 46.49 feet to the TRUE POINT OF BEGINNING. Thence continuing along said radial line South lO"39'00" East 13.51 feet to a point on the arc of a 15.00 foot radius curve concave Southeasterly, a radial line through said point bears South 1O039'0O'' East; Thence Southwesterly along the arc of said curve through a central angle of 88O09'50" a distance of 23.08 feet to a point, said point being on the arc of a 370 foot radius curve concave Easterly, a radial line to said point bears North 81"ll'lO" East; Thence Northwesterly along the arc of said curve through a central angle of l"32'22" a distance of 9.94 feet to the beginning of a compound curve, said point has a radial line which bears North 82'43'32" East; Thence Northeasterly along the arc of a 20.00 foot radius curve concave Ssutheasterly through a central angle of 71°00'23" a distance of 24.78 feet to the TRUE POINT OF BEGINNING.
