DECISION OF THE PLANNING COMMISSION RE- The City Council of the City of Carlsbad does hereby resolve as follows: 1. Appellant BAYSHORE INNS appealed to the City Council the 2ction of the Planning Commission regarding this herein mentioned ipplication - Planning Commission Resolution No. 654. 2. All steps required by law in connection with saidapplicati( nnd appeal have been complied with. 3. Said appeal and application are granted and the following iction in regard thereto is taken: A variance was granted to illow a 5' sideyard set back on property located at 2687 Ocean itreet. 4. In the opinion of the City Council the following facts .nd reasons make the granting or denial of said application necess- .ry to carry out the general purpose of Ordinance No. 9060 as mended: [as good use of the property, as it would act as a fire stop in his area. 5. The Fire Department recommended that this construction Said action regarding said application is made subject o the following conditions and limitations: a) Any structure regardless of height that is built n this site, shall be constructed to the requirements of the "Life afety Code" N.B.F. U. pamphlet #101, and to a Class 2 Fire Zone. i.e., Fire resistive exterior walls and roof). Also any opening ithin 10' of the lot line shall be protected by a fire protective ssembly (wire glass, etc.). No projections or obstructions (trash cans, storage, etc.) shall be allowed in this area at any time, except for gates if desired at the ends. c) The balconies on the east side of the building and the covered walk-way from the lower parking level to the building shall be equipped with a fire sprinkler system. d) No construction shall be started until a double 4" fire hydrant on a 6" riser is installed on at least an 8" main on the corner of Beech and Ocean*Streets. e) All other requirements of the Uniform Building Code shall be strictly adherred PASSED, APPROVED, and ADOPTED at a regular meeting of the City Council of the City of Carlsbad, California, held on the 3rd day of March, 1970, by the following vote, to wit: AYES: Councilman Dunne, Neiswender, Jardine and Castro.
