CI 4 5 6 7 e 9 LO 3.3. 12 13 1.2: 3.5 16 17 18 19 20 21 2% 22 24 25 2E ,27 2f 25 3( 3: 3: RESOLUTION NO. 18 54 A RES0 UTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD CALLING A PUBLIC HEARING TO DETERMINE WHETHER PUBLIC HEALTH, SAFETY, OR WELFARE REQUIRES THE FORMATION OF AN UNDERGROUND UTILITY DISTRICT ON ELM AVENUE FROM THE WESTERLY RIGHT OF WAY LINE OF INTERSTATE 5 TO THE EAST BOUNDARY OF UNDER- GROUND DISTRICT NO. 1 AND EXTENDING 75 FEET ON THE SOUTH SIDE OF ELM AVENUE AND 50 FEET ON THE NORTH SIDE OF ELM AVENClE. BE IT RESOLVED by the Council of the City of Carlsbad as follows: WHEREAS, Ordinance No, 7037 establishes a procedure for the creation of underground utility districts and requires as the initial step in such procedure the holding of a public hearing to ascertain whether public health, safety, or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facili- ties for supplying electric, communication, or similar or associ- ated service in any such district: and WHEREAS, it has been recommended that such an underground utility district, hereinafter called the District, be €ormed on Elm Avenue from the Westerly right of way line of Interstate 5 to the East boundary of Underground District No, 1 and extending 75 feet on the South side of Elm Avenue and 50 feet on the North side of Elm Avenue. NOW, THEREFORE, Be it Resolved as follows: 1. NOTICE IS HEREBY GIVEN that a public hearing will be held by the Council of the City of Carlsbad on June 15, 1971, at the hour of 7:30 P, M. in the Council Chambers of the City Hall, Carlsbad, California, to ascertain whether the public health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installatio of wires and facilities for supplying electric, communication, or similar associated service in the District hereinabove described. At such hearing all persons interested shall be given an opportunity to be heard. to time as may be determined by the City Council. 3. Said hearing may be continued from time The City Clerk shall notify all affected property owners as shown on the last equalized assessment roll and utilities con- cerned of the time and place of such hearing by mailing a copy of this resolution to such property owners and utilities concernec at least ten (10) days prior to the date thereof. 4. The area proposed to be included in the District is shown upon that certain map entitled "Map of Proposed Underground Utili- ties District No. 2", dated May 6, 1971 , which is on file in the office of the City Clerk of the City of Carlsbad.
