HomeMy WebLinkAbout1972-05-16; City Council; Resolution 20131 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 * 24 25 26 .27 28 29 30 31 32 RESOLUTION NO. 2013 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD GRANTING APPEAL OF DECISION OF PLANNING COMMISSION RE- GARDING a Specific Plan to allow for reduction in required parking spaces from 35 to 18, on portion of ProDertv located northerly of Chestnut Ave. between 1-5 and Harding st. - (Appleby Investment Development) The City Council of the City of Carlsbad does hereby resolve as follcws: 1. Appellant APPlebY Investment Development appealed to the City Council the action of the Planning Commission regarding his herein mentioned application - Planning Commission Resolution. No. 770 2. All steps re.quired by law in connection with said applica- tion and appeal have been complied with. 3. Said appeal and application are granted and the following action in regard thereto is taken: , 4. In the opinion of the City Council the following facts .. and reasons make the granting of said application necessary to carry out the general purpose of Ordinance Flo. 9060 as amended: 1) The Housing Advisory Board of the City of Carlsbad has re- quested more green area. 2) It has been established by other cities that the requirement for parking is not necessary for elderly occupants. 3) It will enhance the development. 5. Said action regarding said application is made subject to the following conditions and limitations: 1) That the 19 parking spaces be developed in the standard manner required. 2) Complete development of remainder of area required for Darkins sPaces, in lawn and shrubs with appropriate sprinkling system. 3) The occupc cy of this facility be restricted to usage by the elderly as provic ed for in the Housing Authority Lease. 4) The installation of the balance of the required parking spaces be completed, prior to occu- pancy; in the event the Housing Authority Lease expires. li 2 3 4 5 6 7 8 i I PASSED, APPROVED, AND ADOPTED at a meeting of the City Council of the City of Carlsbad, California, held May 16th 1972, by the following vote, to wit: I - AYES: Cmn.
