RESOLUTION NO. 2031
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD AUTHOR IZ I NG THE PURCHASE OF A PORT I ON
IF NECESSARY, TO ACQU I RE SA ID PORT I ON.
BE IT RESOLVED by the City Council of the City of Carlsbad
OF PARCEL 203-1 02-36 BY NEGOT lATl ON OR CONDEMNAT I ON,
as fol lows:
1. That the City finds and determines the described parcel
of real property, more particularly described on Exhibit "A",
attached hereto, and by this reference incorporated herein.
2. That the public interest and necessity require the
acquisition by the City of said seven foot strip for an easement
for street purposes.
3. That the public interest and necessity require the
installation of a sidewalk and the relocating of a portion of
existing fence southerly for improved sight distance.
4. That the City Attorney of the City of Carlsbad is
hereby authorized and directed on the behalf of the City to
acquire said parcel by negotiation, or by condemnation, under
the laws of eminent domain of the State of California, if
negotiations are unsuccessful, and to pay the cost of said
acquisition from City funds.
PASSED, APPROVED AND ADOPTED on this 20th day of June
1972, by the following votes to wit:
AYES: Cmn. Dunne, McComas, and Frazee.
NOES : None.
ABSENT: None.

All that property between the Northerly boundary and a
line parallel and seven (7') feet southerly of said northerly
boundary of Parcel 203-102-36.
