A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD
DENYING APPEAL OF DECISION OF PLANNING COMMISSION RE-
GARDING A CHANGE OF ZONE FROM R-1-10,OOO TO C-1, R-3, AND R-1-6,000 ON PROPERTY LOCATED ON THE EASTERLY SIDE OF EL CAMINO REAL AND ON THE SOUTHERLY SIDE OF HIGHWAY 78. (Challenge Builders, Inc.)
The City Council of the City of Carlsbad does' hereby resolve
as follows:

the City Council the action of the Planning Commission regarding
his herein mentioned application - Planning Commission Resol-ution
No. 797
2. All steps required by law -in connection 'with'said applica-
tion and appeal have been complied with.
3. Said appeal and application are denied and the following
action in regard thereto is taken:
4. In the opjnion of the City Council the following facts
and reasons make the denying of said application necessary to
carry out the general purpose of Ordinance No. 9060 as amended: (a) Pursuant to Section 11549.5 of the Subdivision Map Act, con- struction in this flood plain is likely to create substantial environmental damage through the resulting destruction of th e flood
plain or will unavoidable injure fish, wildlife or their habitat.
(b) The proposed densities are in conflict with recommendations ot the General Plan. (c) Flood plain development is under review as a portion of the Planning Department General PI an Kevision Study ot
physiographic resources and community design and preparation of conservation element of a comprehenslve General Pi an revision.
PASSED, APPROVED, AND ADOPTED AT a meeting of the City
Council of the City of Carlsbad, California, held August 15,
1972, by the following vote, to wit:
