RESOLUTION NO. 3007
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, ANNOUNCING FINDINGS AND DECISION REGARDING CHANGE OF ZONE FROM R-A-10,000 TO C-2 AND ADOPTION OF A SPECIFIC PLAN, ON PROPERTY LOCATED ON THE EAST SIDE OF THE'EXISTING JEFFERSON STREET AND NORTH 0 PROPOSED MA'RRO ROAD. -[Fawco)
WHEREAS, on the 10th day of October, 1972, the Carlsbad City
Planning Commission adopted Resolution No. 841, which is herewith
referred to and made a part hereof; and
WHEREAS, on October 30, 1972, a duly advertised Public Hearing
was held as prescribed by law to consider a Change of Zone from
R-A-10,000 To C-2 (General Commercial) Zone; and Adoption of a Specif
Plan on property described as:
A parcel of land in the City of Carlsbad, County of San Diego, State of California, being a portion of Hosp Eucalyptus Forest Company's Tract according to map thereof No. 1136, filed in the Office of the County Recorder of said County, June 8, 1908, and more particularly described in application on file in the Office of the City Clerk.
WHEREAS, the City Council received all recommendations and

Zone and Adoption of Specific Plan;
NOW, THEREFORE, the City Council of the City of Carlsbad DOES
HEREBY DECLARE FINDINGS AND RESOLVE that the findings of the Planning
Commission contained in Resolution No. 841 constitute the findings
of the City Council of the City of Carlsbad.
BE IT FURTHER DECLARED AND RESOLVED that the City Council
certifies that the approval of the proposed change of zone classifi-
cation and the adoption of the Specific Plan is necessary to carry
out the general purpose of Ordinance No. 9060, as amended.

BE IT FURTHER RESOLVED that the City Council of the City of
Carlsbad does hereby declare its intention to adopt an ordinance to
effectuate the proposed change of zone classification.
PASSED, APPROVEDy AND ADOPTED at an adjourned regular meeting
of the City Council held on the 30th day of October, 1972, by the
following vote, to wit:
AYES: Councilmen Dunne, McComas, Chase and Frazee.
NOES: Councilman Lewis

A RESOLUTION OF THE CARLSBAD CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL A CHANGE OF ZONE FROM
ON PROPERTY LOCATED EAST OF JEFFERSON STREET, NORTH OF THE PROPOSED MARRON ROAD
R-A-10,000 to C-2 AND THE ADOPTION OF A SPECIFIC PLAN
WHEREAS, pursuant to the provisions of Title 21 of the Carlsb
qunicipal Code, the Carlsbad City Planning Commission did on Octob
10, 1972, hold a duly noticed public hearing to consider the appli
tion of Fawco, a Partnership, for a Change of Zone from R-A-10,OUO
to C-2 and the Adoption of a Specific Plan on property located eas
if Jefferson Street, north of the proposed Marron Road, and more
jarticularly described as follows:
A parcel of land in the City of Carlsbad,
County of San Diego, State of California,
being a portion of Hosp Eucalyptus Forest
Company’s Tract according to map thereof ::
No. 1136, filed in the Office of the County
Recorder of said County, June 8, 1908, and
more particularly described in zpplication
on file in the City Planning Office.
WHEREAS, at said public hearing, upon hearing and considering
ihe testimony and arguments, if any, of a17 persons who desired to
)e heard, said Commission did find the following facts and reasons
to exist which make the approval of the application for change of
!one necessary to carry out the provisions and general purpose of
ritle 21 of the Carlsbad Municipal Code:
1. The subject proposal is in the best interest of the City of
Zarlsbad.
1. The subject reclassification and specific plan will not be
detrimental to surrounding properties.
MOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Carlsbad that it does hereby recommend to the City

Council the adoption of an amendment to Title 21 of the Carlsbad
Municipal Code, chanigng the existing R-A-10,000 Zoning to C-2
Zoning and the Adoption of a Specific Plan for development subject
to the following conditions and limitations:
I. That a Specific Plan for any phase of development shall be
submitted to the City of Carlsbad prior to the issuance of any
?emit for building or grading and shall include at least the'
following:
a. Landscape and Sprinkler Plans
b. Height, size and location of all signing as permited
c. Spatial relationships of all proposed buildings and in the City of Carlsbad Sign Ord. 9224
structures as they relate to the existing portions of Plaza Camino Real
2.
d. Points of ingress and egress to the proposed shopping center from Marron Road and Jefferson Street shall be limited and shall be subject to the approval of the City Engineer e. An Environmental Impact Statement shall be submitted to the City of Carlsbad for review simultaneously with said Specific Plan application I
That a request for a General Plan Amendment shall be submittel
to trle City of Carlsbad by October 13, 1972.
3. A hold harmless agreement shall be signed by applicant and
placed on file with the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Planning Commission held on the 10th day of October,
1972, by the following vote, to wit:
AYES: Commissioners Norman, Jose, Little and Dewhurst'
NOES: Commissioners Palmateer and Dominguez
ABSENT: Commissioner Forman
