RESOLUTION NO. 3020 -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD AUTHORIZING THE MAYOR TO EXECUTE AN
AGREEMENT FOR THE LEASE OF THE TRI-CITY AUTO DEALERS ASSOCIATION ACCESS ROAD BETWEEN CANNON ROAD AND PALOMAR AIRPORT ROAD FROM SAID ASSOCIATION
WHEREAS, the City Council in Resolution 1972 expressed
its intent to construct a street between Cannon Road and Palomar
Airport Road in connection with the location by the Tri-City Auto
Dealers Association of six new automobile dealerships in the City
of Carlsbad by 1975; and
WHEREAS, the City is not prepared to construct said road at
this time and desires to utilize the alternative procedures for
said construction as provided in Resolution 1972; and
WHEREAS, said Association is prepared to cpnstruct said road
and lease it to the City on a yearly basis pursuant to Resolution
1972; and
WHEREAS, a lease-leaseback agreement detailing the rights
and obligations of the City and the Association in regard to the
road has been prepared to the satisfaction of all parties and
is now ready for execution,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. The Mayor of the City of Carlsbad is hereby authorized
to execute on behalf of the City a lease-leaseback
agreement with the Tri-City Auto Dealers Association.
A copy of said agreement is attached hereto and made
a part of this Resolution and describes the rights,
duties and obligations of both parties in regard to
the road.

PASSED, APPROVED, AND ADOPTED at an adjourned regular meet-
ing of the City Council held on the 21st day of November, 1972,
by the following vote, to wit:
AYES : Cmn. Dunne, McComas, Lewis, Chase and Frazee.
NOES : None.
