HomeMy WebLinkAbout1973-01-16; City Council; Resolution 3040RESOLUTI.ON NO. 3040 6 7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING FINDINGS AND DECISION REGARDING AN AMEND- MENT TO THE MUNICIPAL CODE TO PROVIDE FOR CIRCUSES AND CARNIVALS UNDER CERTAIN CIRCUMSTANCES ON APPROVAL OF THE CITY MANAGER. WHEREAS, on the 12th day of December, 1972, the Carlsbad City Planning Commission adopted Resolution No. 859, which is 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 21 28 29 30 31 32 herewith referred to and made a part hereof; and WHEREAS, on January 2, 1973, a duly advertised Public Hearing was held to consider the proposed amendment to Section 21.42.010 of the Carlsbad Municipal Code; and WHEREAS, the City Council received all recommendations and heard all persons interested in or opposed to the proposed amendment; NOW, THEREFORE, the City Council of the City of Carlsbad hereby find, and adopt as the findings of the City Council the recommendations of the Planning Commission as set forth in the above referenced resolution of the Planning Commission. IT IS HEREBY CERTIFIED by the City Council of the City of Carlsbad that the approval of the proposed amendment is necessary to carry out the general purpose of Ordinance No. 9060, as amended. IT IS HEREBY DECLARED by the City Council of the City of Carlsbad that said City Council intends to adopt an ordinance to effectuate the proposed amendment. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 16th day of January, 1973, by the following vote, to wit: AYES : Counci lmen Dunne, McComas , Lewis , Chase and Frazee. NOES: None. ABSENT: None. , ATTEST:
