RESOLUTION NO. -3096
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, DENYING A CLAIM AGAINST THE CITY, SUBMITTED BY MR. AND MRS. LOU.I_S VAN- MOPPES ,_, . ,., , .
WHEREAS, on February 8, 1973 a claim against the City of
zarlsbad was filed by Mortimer 81 Gray, Attorneys on behalf of
4r. and Mrs. Louis Van Moppes, in the amount of $4,005,000,
ind
WHEREAS, state law requires that the City Council consider
ill claims and act to apprave, approve in part, or deny said
:laim,
NOW THEREFORE BE IT RESOLVED by the City Council of the
:ity of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the City Council has heard and considered the facts and circums-tances of the above described claim.
3. That the City Council hereby denies said claim.
4. That the City Clerk is directed to %orward a copy of this resolution to the Claimants and to the City's insurance carrier, and to comply
with a1 1 other noti ce requi rements provided by law.
PASSED, APPROVED AND ADOPTED by the City Council of the
:ity of Carlsbad at a regular meeting held on the 20th day
if March, 1973, by the following vote, to wit:
AYES: Councilmen Dunne, McComas, Lewis and Frazee.
NOES: None.
ABSENT: Councilman Chase.
