HomeMy WebLinkAbout1973-04-17; City Council; Resolution 31061 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 20 CITY COUNCIL RESOLUTION NO. 3106 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING TENTATIVE CONDOMINIUM PROJECT OFI PROPERTY LOCATED ON THE SOUTHERLY SIDE OF LA COSTA AVENUE BETWEEN EL CAMINO REAL AND NUEVA CASTILLA WAY. ( LA COSTA DE MARABELLA ASSOCIATES) MAP (CT-73-7) FOR DEVELOPMENT OF A 58-UNIT IrlHEREAS, on the 27th day of March, 1973, the Carlsbad City Planning Commission adopted Resolution No. 882, recommending to the City Council that Tentative Tract Map CT-73-7 be conditionally approved; and, WHEREAS, the City Council of the City of Carlsbad, on the 17th day of April, 1973, considered the recommendation of the Planning Commission; and WHEREAS, said Tentative Map has complied with the requirements of the "City of Carlsbad Environmental Protection Ordinance of 1972" and has been declared to have a 'Inon- significant" impact on the environment; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, that Tentative Map CT-73-7, is hereby approved, subject to the execution and/or fulfillment of the foll owing condi ti ons : 1. The applicant shall install full frontage improvements (to include sidewalk and street lights). 2. The driveway access shall be perpendicular to La Costa Avenue and be no steeper than five (5%) per cent within twenty (20) feet of the La Costa Avenue right-of-way line. 3. The subject property shall comply with all of the rules and regulations of the Carlsbad Municipal Water District with respect to water service for condominium projects. 6. It is strongly urged that the applicant work together with the Encinitas Union School District to develop some mutual agreement regarding school impact caused by growth. 7. On-site fire protection appurtenances shall be constructed in accordance with Fire Department requirements to the satisfaction of the Fire Chief. Said fire appurtenances shall be installed and functioning prior to framing construction. 8. All domestic water supplied to this subdivision shall come from the Carlsbad Municipal Water District. 9. The sewer service for this subdjvjsjon shall be provided by Leucadta County Nater Distrtct. 10. The water and sewer lines shall not be laid in the same trench. 11. Proper drainage shall be maintained so as to prevent ponding and/or storage of surface water. 12, Park-in-Lieu fees shall be paid prior to recordation of Final Map. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to place a copy of this resolution in the usual course of mail, addressed to the subdivider, at his address shown on the Tentative Map.
