RESOLUT I ON NO. 31 107
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD D I RECT I NG THAT A REQUEST FOR ALLOCAT I ON
OF FUNDS BE SUBMITTED TO THE PUBLIC UTILITIES
COMMISSION TO REIMBURSE THE CITY FROM THE CRDSS-
ING PROTECTION FUND FOR ONE-FOURTH OF THE ACTUAL
COST OF CROSSING PROTECTION AT THE CANNON ROAD
(CROSSING 2-231.4), TAMARACK AVE. (CROSSING 2-
(CROSSING 2-229.2), BEING CROSSINGS OF THE TRACK OF THE ATCHISON, TOPEKA, AND SANTA FE RAILWAY COMPANY.
230.11, ELM AVE. (CROSSING 2-229.31, AND GRAND AVE.
WHEREAS, the City of Carlsbad was ordered by the Public
Utilities Commission per case No. 9328, to install crossing
protection consisting of flashing light signals supplemented with
automatic crossing gates at Tamarack Ave. (Crossing 2-230.11, Elm
Ave. (Crossing No. 2-229.3), and Grand Ave. (Crossing 2-229.2); and
WHEREAS, the City of Carlsbad was authorized by the Public
Utilities Commission per application No. 51157 to construct Cannon
Road (Crossing 2-231.4) at grade across tracks of the Atchison,
Topeka and Santa Fe Railway providing the crossing be protected
with flashing light signals supplemented with automatic crossing
gates; and
WHEREAS, the City Council has approved agreements with the
Santa Fe Railway to pay a portion of the cost of the installation
of crossing protection as follows:

NOW, THEREFORE, BE IT RESOLVED by this City Council that a
request for allocation of funds be submitted to the Public Utilitie
Commission to reimburse the City from the crossing protection fund
for one-fourth of the actual cost of crossing protection at the

the following vote, to wit:
