HomeMy WebLinkAbout1973-05-01; City Council; Resolution 31191 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION NO. - 3119 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROYING THE USE OF STATISTICAL SAMPLING TECHNIQUES IN THE DISTRIBUTION OF CERTAIN COURT FINES AND FEES -PURSUANT TO SECTION 1463.5 OF THE PENAL CODE. WHEREAS, Senate Bill 491 added Section 1463.5 to the Penal Code to provide that the distribution of funds required by Penal Code Section 1463 and of assessments collected under Penal Code Section 13521 and Vehicle Code Sections 42006 and 42050 may be made upon a probabil'ty sampling basis provided such procedure is prescribed by the County Auditor; and MHEREAS , the County Auditor has prescribed such procedures and has requested that the City of Carlsbad approve them in order to meet in part the requirements for their implementa- tion; and WHEREAS, it appears to be in the public interest for the City of Carlsbad to give such approva'l; NOW, THEREFORE, BE IT RESOLVED as follows: 1. That the above recitations are true and correct. 2. That the City of Carlsbad approves the use of statistical sampling techniques in the distribution of certain court fees and fines as provided in Section 1463.5 of the Cal iforni a Penal Code. 3. That the City Clerk is directed to forward a copy of this resolution to the County Auditor.
