HomeMy WebLinkAbout1973-05-01; City Council; Resolution 3120L 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION NO. 3'1 20 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING TENTATIVE UNITS, ON PROPERTY LOCATED EASTERLY OF ALTISMA WAY AND SOUTHERLY OF THE 100' SAN DIEGO GAS AND ELECTRIC COMPANY EASEMENT IN LA COSTA, TO BE KNOWN AS ALICANTE HILLS, MAP (CT 72-25) FOR DEVELOPMENT OF CONDOMINIUM WHEREAS, on the 10th day of Apri'l, 1973, the Carlsbad City Planning Commission adopted Resolution No. 886, recommending to the City Council that Tentative Tract Map CT 72-25 be conditionally approved; and WHEREAS, the City Council of the City of Carlsbad, on the 1st day of May, 1973, considered the recommendation of the Planning Commission; and WHEREAS, said Tentative Map has complied with the requirements of the "City of Carlsbad Environmental Protection Ordinance of 1972" and has been declared to have a "non- significant" impact on the environment; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, that Tentative M,ip CT 72-25, is hereby approved, subject to the execution and/or fulfillment of the fol 1 owl ng condi ti ons : 1. The applicant shall endeavor to obtain a mutual agreement with the Richmar Union School District and Escondido Union School District to provide for future school requirements that will result from the construction of these residences. 2. The development shall comply with all City health standards. 3. Park-in-lieu fees shall be paid prior to recording the Final map. 4. Street tree easements and street trees shall be provided per requirements of the Parks and Recreation Department. 5. All public improvements shall be installed as required by Ordinance and otlier City standards to -1- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 the satisfaction of the City Engineer. 6. The applicant shall offer for dedication 60' right- of-way between Gibralter Street and Alfil Way, together with sufficient slope rights to construct standard public improvements. Applicant shall enter into an agreement with the City to construct a standard 4O'curb- -to-curb public street or a 24' wide paved emergency roadway within said right-of--way. Construction shall take place when required by the City. The public street shall only be required when adopted as part of the Circulation Element of the General Plan. 7. Almaden Lane shall be provided with a standard cul-de-sac turn-around at its easterly terminus, to the satisfaction of the City Engineer. 8. The intersection of Alicante Road and Altisma Way shall be re-aligned to conform to City of Carlsbad Standard Design Criteria or as approved by the City Engineer. 9. Grading permits shall not be issued until the City Engineer approves the proposed method of eliminating or minimizing any siltation or run-off that may occur during the grading operation. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 1st day of May, 1973, by the following vote, to wit: AYES: Cmn. Dunne, McComas, Lewis, Chase and Frazee.
