HomeMy WebLinkAbout1973-05-01; City Council; Resolution 3123RESOLUTION NO. 3123 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD DENYING THE APPEAL OF A PLANNING COMMISSION DECISION TO GRANT A CONDITIONAL USE PERMIT FOR CONSTRUCTION OF A CHURCH (CHURCH OF THE NAZARENE) AND RELATED FACILITIES, ON PROPERTY GENERALLY LOCATED AT 2675 HIGHLAND DRIVE. WHEREAS, the Planning Commission of the City of Carlsbad, California, did on March 27, 1973, after public hearing, adopt Resolution No. 884 granting a conditional use permit for the construction and operation of a church and related facilities on property generally located at 2675 Highland Drive. Said resolution is incorporated by reference herein; and MHEREAS, a proper appeal of said decision has been fi1ed;and WHEREAS, the City Council did on May 1, 1973, hold a public hearing on said appeal and hear and consider all testimony, reports and communications presented; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the appeal is hereby denied and the decision of the Planning Commission in granting the conditional use permit is affirmed for the following reasons: (a) Planning Commission Resolution No. 884 and the staff report justify the granting of the permit; (b) The evidence forthcoming at the hearing on the appeal did not call any of those findings or reasons into question; (c) The findings and reasons for approval contained in said resolution and report constitute the findings of the City Council on this appeal and justify the denial of same. /// /I/ 1. PASSED, APPROVED AND ADOPTED at the regular meeting of the Carlsbad City Council, held on the 1st day of May, 1973, by the following vote, to wit: AYES : Cmn. Dunne, McComas, Lewis, Chase and Frazee.
