I. 1 2 3 4 5 6 7 8 9 10 11 12 13 Q 14 .a fl O 8 15 E5 16 OLW5 no=$ -I 17 5a 5k86 gE22 18 zi2 fl '5 = 19 bo gG0 ,;e wu 20 21 22 23 24 25 26 27 28 29 30 31 32 I- o RESOLUTION NO. 3125 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING FINDINGS AND DECISION REGARDING CHANGE OF ZONE FROM R-1-10,000 TO P-C (Planned Community) FOR PHASE If AND 111, ON 79.4 ACRES OF LAND GENERALLY LOCATED SOUTH OF PALOMAR AIRPORT ROAD AND EAST OF LOWDER LANE (A. McReynolds). WHEREAS, on April 24, 1973, a duly advertised Public Hearing was held before the Planning Commission in the manner prescribed by law to consider a change in zone from R-1-10,000 to P-C, on Phase If and 111, property generally located south of Palomar Airport Road and East of Lowder Lane, more particularly described as: That portion of Lot "Hi' of Rancho Agua Hedionda, in the County of San Diego, State of California, according to Map thereof No, 823, filed in the Office of the County Recorder of said County, November 16, 1896. WHEREAS, at the conclusion of said hearing, the Planning Commission of the City of Carlsbad, adopted Resolution No. 895 recommending said zone change which is herewith referred to and made a part hereof; and WHEREAS, on May 15 , 1973, the City Council held a public hearing on the matter, received all recommendations and heard all persons interested in or opposed to the proposed change of zone; and WHEREAS, said application has complied with the require- ments of the "City of Carlsbad Environmental Protection Ordinance of 1972", and an Environmental Impact Report was filed and discussed at a duly noticed public hearing held by the Planning Commission on April 24, 1973, and was approved as presented; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. 1. That the above recitations are true and correct. 2. That the findings of the Planning Commission contained in the aforementioned Resolution No. 895 constitute the findings of the Carlsbad City Council. 3. That the approval of the proposed change of zone classifixation is necessary to carry out the general purpose of Title 21 of the Municipal Code. 4, That the City Council of the City of Carlsbad intends to adopt an ordinance to effectuate-the proposed change of zone. PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council on the 15th day of May , 1973, by the following vote, to wit: AYES : Councilmen McComas , Lewis, Chase and Frazee. NOES : Councilman Dunne. ABSENT: None. ATTEST: (Sea?) 2.
