HomeMy WebLinkAbout1973-08-07; City Council; Resolution 3169,_41* .-. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION NO. 3169 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING FINDINGS AND DECISION REGARDING SPECIFIC TOWNHOUSE CLUSTER ON PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE OF POINSETTIA LANE BETWEEN 1-5 AND LAGOON LANE. (Covi ngton Brothers/Occi dental Petroleum Land and Development Corporation) PLAN FOR DEVELOPMENT OF A 300-UNIT WHEREAS, on the 26th day of June, 1973, the Carlsbad City Planning Commission adopted Resolution No. 922 which is herewith referred to and made a part hereof: and WHEREAS, on June 26, 1973, a duly advertised Public Hearing was held in the manner prescribed by law to consider the Specific Plan (SP-122) to allow for development of a 300-unit townhouse cluster on property described as: A portion of Section 28, Township 12 South Range 4 West, San Bernardino Base and Meridian, City of Carlsbad, County of San Diego, State of California; and WHEREAS, on August 7th , 1973, the City Council held a duly advertised public hearing and received all recommendations and heard all persons interested in or opposed to the proposed Specific Plan; and WHEREAS, said .application has complied with the requirements of the "City of Carl sbad Environmental Protect Ordinance of 1972" and an Environmental Impact Report was presented and discussed at a duly noticed public hearing he by the Planning Commission and the City Council and was approved as presented; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. on d 2. That the approval of the proposed specific plan is necessary to carry out the general purpose of Title 21 of the Carlsbad Municipal Code. 4, That the specific plan recommended by Planning Commission Resolution No. 922 is hereby approved, subject to the conditions of said resolution, with the exception of condition no. 21 which is modified to read as follows: "The Developer is encouraged to work with the Carlsbad Union School District to provide for future school requirements that will result from the proposed development." PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council on the 7th . day of Auaust , 1973, by the following vote, to wit: AYES: Councilmen Dunne, McComas, Lewis, Chase and Frazee.
