HomeMy WebLinkAbout1973-09-04; City Council; Resolution 32061 2 3 4 5 6 7 8 9 10 11 12 13 RESOLUTION NO. 3206 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING THE GENERAL PLAN TO CHANGE THE RESIDENTIAL DENSITIES ON PROPERTY GENERALLY LOCATED NORTHERLY OF THE BATIQUITOS LAGOON AND GENERALLY SOUTH OF PALOMAR AIRPORT ROAD. (La Costa - Ayres) BETWEEN EL CAMINO REAL AND INTERSTATE-5, WHEREAS, the City of Carlsbad Planning Commission did on the 24th day of July, 1973, hold a duly advertised public hearing as prescribed by law, to consider an amendment to the General Plan as follows: "Adopting Land Use Amendment No. 4 (Residential Density Portion) of the City of Carlsbad General Plan, specifying that residential densities be amended from the existing residential estate low density (0-2 du/ac.) , residential low- density (3-7 du/ac.), tourist resort and neighborhood commercial to residential low density (0-5 du/ac.), and residential medium density (0-10 du/ac.)", on property generally located between El Camino Real and Interstate-5, northerly of the Batiquitos Lagoon and generally south of Palomar Airport Road, and more particularly described as: Being those portions of land in Sections 22, 26, 27, 28 and 35 in Township 12 South, Range 4 West, San Bernardino Base & Meridian, in the City of Carlsbad, County of San Diego, State of California. WHEREAS, the Planning Commission adopted Resolution No. 940 recommending said amendment to the City Council; and WHEREAS, on September 4, , 1973, the City Council held a duly advertised public hearing to consider said amendment; and WHEREAS, at said public hearing the City Council received the recommendations, objections, protests, and comments of all individuals and parties who desired to be heard; WHEREAS, the applicant has met the requirements of the 1. "City of Carlsbad Environmental Protection Ordinance of 1972" and an Environmental Impact Report was filed and discussed at a duly noticed public hearing held by the Planning Commission and City Council and was approved as presented; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the findings of the Planning Commission as set forth in Planning Commission Resolution No. 940 constitute the findings of the City Council. 3.
