HomeMy WebLinkAbout1973-09-04; City Council; Resolution 3210RESOLUTION NO. 3210 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING CONDOMINIUM DEVELOPMENT ON PROPERTY LOCATED NORTH OF AND ADJACENT TO JUNIPER AVENUE BETWEEN GARFIELD STREET AND THE KNOWN AS "LA CASA DE LA PLAYA." TENTATIVE MAP (CT 73-30), A 16-UNIT A.T. & S.F. RAILROAD RIGHT-OF-WAY, TO BE WHEREAS, on the 14th day of August, 1973, the Carlsbad City Planning Commission adopted Resolution No. 938, recommending to the City Council that Tentative Map (CT 73-30) be conditionally approved; and WHEREAS, said Tentative Map has complied with the requirements of the "City of Carlsbad Environmental Protection Ordinance of 1972" and has been declared to have a non-signifi- cant impact on the environment. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, as follows: A. That the above recitations are true and correct. B. That Tentative Map (CT 73-30) is hereby approved, subject to the execution and/or fulfillment of the following conditions : 1. All conditions as specified in Ordinance No. 9225 (Garfield Specific Plan) shall be complied with, except that parking shall be provided to conform to the existing Zoning Ordinance requirements, and no tandem spaces shall be provided. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, I// /// /// /// 1. //I /I/ /I/ //I 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 0 I limitations and restrictions of all municipal ordinances and State and Federal statutes now in force, or which, hereafter, may be in force for the purpose of preserving the residential characteristics of adjacent properties. 3. The developer shall establish and hereafter maintain a Homeowner's Association for the purpose of maintenance of buildings, open space and parking areas. 4. The C.C. & R's for this development shall be submitted to the Planning Director for review and approval prior to the issuance of any building permits. 5. Park-in-lieu fees shall be granted to the City prior to recording the Final Map. 6. Prior to final building inspection clearance, all landscaping shall be installed. Landscaping shall, at all times, be maintained in a manner acceptable to the Planning Director. All landscape areas in parking lots shall be enclosed by a raised concrete curb or low wall. All planters adjacent to street right-of-way shall be constructed with weep holes per specifi- cations of the City Engineer. That said Tentative Map together with the provisions for its design and improvement and subject to the above conditions, is consistent with all applicable general and specific plans of the City of Carlsbad.
