HomeMy WebLinkAbout1973-10-16; City Council; Resolution 3245. .. .). 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 1E 17 1E 1s 2c 21 22 2: 24 2c 2E 27 2€ 2s 3C 31 32 RESOLUTION NO. 3245 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING WITH THE DEVELOPMENT OF 39 SINGLE FAMILY LOTS ON 11.7 ACRES OF LAND, GENERALLY LOCATED ON THE NORTH END OF CORDOBA PLACE BETWEEN HILLSIDE AND AVILA STREETS, TO BE KNOWN AS LAGUNA RIVIERA NO. 8. APPLICANT: JERRY L. ROMBOTIS. CONDITIONS TENTATIVE MAP (CT 73-5) TO ALLOW WHEREAS, on the 25th day of September, 1973, the Carlsbad City Planning Commission adopted Resolution No. 965, recommending to the City Council that Tentative Map (CT 73-5) be conditionally approved; and WHEREAS, the City Council of the City of Carlsbad, on the 16th day of October, 1973, considered the recommendation of the Planning Commission; and WHEREAS, said Tentative Map has complied with the requirement: of the "City of Carlsbad Environmental Protection Ordinance of 1972" and has been declared to have a non-significant impact on tht environment; NOW, THEREFORE, BE IT RESOLVED by the City Council of the Citj of Carlsbad, as follows: A. That the above recitations are true and correct. B. That Tentative Map (CT 73-5) is hereby approved, subject to the execution and/or fulfillment of the following conditions: 1. Lots 228-237, 239, 241, 243, 245-247, 250-256, and 258-263, as shown on the map labeled Exhibit A, shall maintain a minimum lot size of 10,000 square feet. All other lots shall be a minimum of 8,000 square feet. 2. All of the conditions of approval of the original tentative map (City Council Resolution No. 1292) shall still be in effect. 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations and restrictions of all municipal ordinances and State and Federal statutes now in force, or which, hereafter, may be in force for the purpose of preserving the residential character- istics of adjacent properties. *- a .= d 1 2 7 u 4 e E 7 € E 1( 11 1: 1: 1d I! 1( 1' 11 I( 21 2 2 2 2 2 2 2 2 2 3 3 3 4. The Developer is encouraged to work with the Carlsbad Unified School District to provide for future school requirements that will result from the proposed development. 5. If requested by the City Engineer, an amended Tentative Map shall be submitted for approval by the City Engineer prior to preparation of the Final Map to assure compliance to all conditions of approval. 6. In order to provide for reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants with required fire flows shall be installed as recommended by the Fire Department. 7. If required by the City Engineering Office, the improvement plans shall include a report of a geological investigation and a complete grading plan of the entire site. The report and plan shall be prepared by civil engineers licensed by the State of California and experienced in erosion control who shall be acceptable to the City Engineer, and they shall certify that they have investigated the site and prepared data with full consideration of the consequences to the included and neighboring properties. 8. All utilities, including provisions for Cable TV, shall be placed underground and/or shall be completely concealed from view, in a manner acceptable to the City Engineer. C. That said Tentative Map together with the provisions for its design and improvement and subject to the above conditions is consistent with all applicable general and specific plans of the City of Carlsbad. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 16th day of October, 1973, by the following vote, to wit: AYES: Councilmen Dunne, McComas, Lewis, Chase and Frazee. NOES: None. ABSENT: NONE. (Seal )
