HomeMy WebLinkAbout1973-10-16; City Council; Resolution 32511 2 z 4 E v E 7 € 9 IC 11 12 12 14 15 16 17 1E 19 2c 21 22 2E 24 2! 2c 2: 2t 2: 3( 31 3: RESOLUTION NO. 3751 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING WITH CON- DITIONS TENTATIVE MAP (CT 73-20) TO ALLOW THE DEVELOPMENT OF A 26-LOT CONDOMINIUM PROJECT OF 96 ACRES OF PROPERTY GENERALLY LOCATED SOUTHERLY OF AND ADJACENT TO LA COSTA AVENUE, IMMEDIATELY WESTERLY OF THE PRESENT WESTERLY MOST EXTENSION OF LEVANTE STREET, TO BE KNOWN AS SPANISH VILLAGE WEST. APPLICANT: LA COSTA LAND CO. WHEREAS, on the 25th day of September, 1973, the Carlsbad City Planning Commission adopted Resolution No. 962, recommend- ing to the City Council that Tentative Map (CT 73-20) be con- ditionally approved; and WHEREAS, the City Council of the City of Carlsbad, on the 16th day of October , 1973, considered the recommendation of the Planning Commission; and WHEREAS, said application has complied with the require- ments of the "City of Carlsbad Environmental Protection Ordinance of 1972" and an Environmental Impact Report was pre- sented and discussed at the Planning Commission as presented; NOW, THEREFORE, BE City of Carlsbad, as fo A. That the above a duly noticed public hearing held by and the City Council and was approved IT RESOLVED by the City Council of the lows: recitations are true and correct. B. That Tentative Map (CT 73-20) is hereby approved, sub- ject to the execution and/or fulfillment of the following con- di tions : 1. Prior to approval of the Final Map on Unit No. 2, the Council shall elect either one of the following to be accomplished: (a) The City Council shall have considered and approved the parks program for the La Costa area and all required parks have been dedicated to the City to meet the Parks Ordinance require- ments for all proposed development in that area covered by the La Costa Master Plan. (b) Lot 135 shall be dedicated to the City of Carlsbad for Park purposes. h 2 2. The open space easement indicated on Lots 119, 120 122, 125, and 126 shall be dedicated to the City of Carlsbad. 4 5 6' 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 3. At the time the final map is approved the applican shall install at his expense a fully actuated traffic signal at the intersection of Levante Street and El Camino Real or shall comply in full with the traffic signal requirements for said intersection pursuant to such a traffic signal policy as may be adopted by the City Council prior to said time. li 'i 4. El Camino Real shall be dedicated and improved on the basis of 126ft. right-of-way to City standards and specifications. 5. La Costa Avenue shall be improved in a manner acceptable to the City Engineer. 6. Prior to the issuance of any permits, the total property shall be annexed to the Leucadia County Water District. 7. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force for the purpose of preserving the residential character- istics of adjacent properties. 8. The C.C. & R's for this development shall be submitted to the Planning Director for review and approval prior to the issuance of any building permits. 9. Developer is encouraged to work with the Encinitas Union and San Dieguito Union High School Districts to provide for future school requirements that will result from the proposed development. 10. All public improvements shall be made in conform- ity to the City of Carlsbad Engineering Design Criteria and Standard Plans, the Subdivision Ordinance and other City Standards to the satisfaction of the City Engineer, without cost to the City of Carlsbad, and free of all liens and encumbrances. Improvement plans for water and sewer system shall meet the re- quirements of the respective service districts. 11. All utilities, including provisions for cable TV shall be placed underground and/or shall be com- pl etely conceal ed from view. 12. Ornamental street lighting shall be provided for as required by Municipal Ordinance Code. The develop- er shall post a bond in the amount necessary to energize said street lights for an eighteen-month period after construction to permit the incorporation of the subdivision into a maintenance district. - 2- .- 11 i i 13. Complete plans and specifications shall be sub- mitted as required for checking and approval, before construction of any improvements is commenced. The subdivider shall submit the original drawings re- vised to reflect as-built conditions, prior to acceptance of the subdivision improvement by the City. 4 3l 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 14. All land/or easements required by this Ordinance shall be granted to the City of Carlsbad without cost to the City, and free of all liens and encumbrances. I1 I 'I 15. All facilities provided to adequately control drainage on the subject property shall be maintained by the property owner(s) in perpetuity. 16. The subdivider shall dedicate to the public all rights of ingress and egress from lots abutting upon restricted access streets and roads over and across the lines of said lots abutting said streets and roads This dedication shall be so designated on the certif- icate sheet of the Final Map with the intent that the owners of said lots will have no rights of access whatsoever to said streets and roads. The words "access rights dedicated to the City" shall be lettere along the road adjacent to the lots affected on the ma proper. This requirement shall apply to lots 108-110 along El Camino Real, and lots adjacent to La Costa Avenue. 17. Street names shall be subject to approval and shall be designated in accordance with the standards and policies adopted by the Planning Commission on file in the Planning Department. Said names shall be approved by the Planning Director prior to recordation of the Final Map. 18. If required by the City Engineering Office, the improvement plans shall include a report of a geolog- ical investigation and a complete grading plan of the entire site. The report and plan shall be pre- pared by Civil Engineers licensed by the State of California, and experienced in erosion control, who shall be acceptable to the City Engineer, and they shall certify that they have investigated the site and prepared data with full consideration of the con- sequences to be included and nei ghbori ng properties. C. That said Tentative Map together with the provisions for its design and improvement and subject to the above condi- tions is consistent with all applicable general and specific plans of the City of Carlsbad.
