HomeMy WebLinkAbout1973-12-04; City Council; Resolution 32794 1 8 9 2 3 4 5 WHEREAS, a duly advertised public hearing was held in the manner prescribed by law to consider the Specific Plan (SP-137) to RESOLUTION NO. 3279 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING FINDINGS AND DECISION AND ADOPTING SPECIFIC PLAN (SP-137) TO ALLOW THE DEVELOPMENT OF A 14-UNIT CONDOMINIUM COMPLEX ON APPROXIMATELY 2.6 ACRES OF LAND, GENERALLY LOCATED EASTERLY OF AND ADJACENT TO EL CAMINO REAL , APPROXIMATELY 450 FEET SOUTHERLY OF THE INTERSECTION OF CHESTNUT AVENUE AND EL CAMINO REAL. APPLICANT: ROBERT KEVANE. 11 allow for the development of a 14-unit condominium complex on property generally located easterly of and adjacent to El Camino Real, approximately 450 feet southerly of the intersection of Chestnut Avenue and El Camino Real, more particularly described as Rancho Agua Hedionda Map Book 208, page 01, Parcels 24 and 25, being a portion of Lot J. of Rancho Agua Hedionda, in the County of San Diego, State of California, according to Partition Map No. 823. WHEREAS, on the 13th day of November, 1973, the Carlsbad City Planning Commission adopted Resolution No. 991, which is herewith referred to and made a part hereof; and WHEREAS, on December 4 - , 1973, the City Counci 21j/ held a duly advertised public hearing and received all recommenda- 22 23 24 25 26 27 28 tions and heard all persons interested in or opposed to the pro- posed Specific Plan; and WHEREAS, said application has complied with the requirement of the City of Carlsbad "Environmental Protection Ordinance of 1972"; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That the approval of the proposed Specific Plan is necessary to carry out the general purpose of Title 21 of the Carlsbad Municipal Code. D. That Specific Plan No. (SP-137) is hereby approved sub- ject to the following conditions: 1, The maximum number of dwelling units shall be limited to fourteen (14). 2. The Specific Plan is granted for the land described in the application and any attachments thereto, and as shown on the plot plan submitted labeled Exhibit A. The location of all buildings, fences, signs, roadways, parking areas, landscaping and other facilities or features shall be located substantially as shown on the plot plan labeled Exhibit A, except or unless indicated otherwise herein. 3. Prior to the issuance of any permits, all require- ments of the Carlsbad Subdivision Ordinance shall be met. 4. Unless the construction of the structure or facility is commenced not later than one year after the date the approval is granted, and is deligently pursued thereafter, this approval will automatically become null and void. 5. Any minor change may be approved by the Planning Director. Any substantial change will require the filing of an application for an amendment to be consid- ered by the Planning Commission. 6. All requirements of any law, ordinance or regula- tion of the State of California, City of Carlsbad, and any other governmental entity shall be complied with. 7. No signs or advertising of any type whatsoever shall be erected or installed until plans therefore have been approved by the City of Carlsbad. 8. All areas shown as parking areas shall be surfaced with asphaltic concrete and shall be visibly marked outlining individual parking spaces and traffic flow. Said surfacing and marking shall be completed prior to final inspection of the structure or structures by the Building Department. The surface shall be kept in a reasonably good state of repair at all times. All garage floors shall be a minimum of Portland Concrete Cement. 9. Prior to obtaining a building permit and within 30 days hereof, the applicant shall file with the Secre- tary of the Planning Commission written acceptance of the conditions stated herein. 10. Deviation from this requirement shall be permitted only by written consent of the Planning Di rector. 11. All lighting shall be arranged to reflect away from adjoining properties and streets. 12. An incombustible trash enclosure shall be provided of a size and location acceptable to the Planning Director, and said area shall be enclosed with a fence and/or wall of sufficient height to adequately shield the area. Said fence and/or wall shall include a solid gate. 13. A detailed landscape and sprinkler plan prepared by a landscape architect, shall be submitted to the Planning Director for consideration and approval. 14. Prior to final building inspection clearance, all landscaping shall be installed. Said landscaping shall at all times, be maintained in a manner acceptable to the Planning Director. 15. All landscape areas in parking lots shall be enclosed by a raised concrete curb or low wall. All planters adjacent to street right-of-way shall be constructed with weep holes per specifications of the City Engineer. 16. The applicant is encouraged to work with the School District to insure that adequate schools will be available when needed. 17. All utilities, including electrical, telephone and cable TV shall be installed underground and/or shall be completely concealed from view. 18. All public improvements shall be made in conformitj with the Subdivision Ordinance and other City Standards , to the satisfaction of the City Engineer, and without cost to the City of Carlsbad, and free of all liens and encumbrances. 19. Prior to the issuance of any permits, a detailed elevation plan shall be submitted to the Planning Director for consideration and approval. Subject development shall be in harmony with the Hispanic motif along El Camino Real. 20. That the applicant shall cause the installation of a six (6) feet high wood fence or masonry wall along the northerly and the easterly property lines along the frontage of all proposed parking areas.
