CARLSBAD, CALIFORNIA, REVISING THE REFUSE COLLEC- Sanitation, Inc. for exclusive refuse collection services within the City; and WHEREAS, the City adopted Resolution No. 1942 setting refuse collection requirements and establishing rates for said services; and WHEREAS, said contract provides that the City will consider changes in said rates based on substantial increases in the Cost of Living Index; and WHEREAS, substantial changes have occurred in said index and the parties to said contract have agreed that certain changes in the refuse collection requirements and rates are necessary; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: WHEREAS, the City of Carlsbad has contracted with McDougal 24 25 26 27 28 29 30 31 32 and McDougal Sanitation, Inc. 3. That the word "residential" in this resolution shall mean all single family dwellings and all duplex units and the word "commercial" shall mean all other types of collection. 4. That residential refuse shall be collected from the curbs of residences during the hours of 7:OO A.M. to 6:OO P.M. at a once a week schedule, and for a monthly charge of $2.75. 5. That special service districts are residential areas within the City of Carlsbad in which the majority of citizens have 20 21 k 0 22 23 1. That the above recitations are true and correct. 2. That this resolution sets requirements and rates for the collection of refuse within the City of Carlsbad and shall consti- tute part of the Agreement for Refuse Collection between the City a 9 10 13. 32 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 31 32 indicated a preference for collection of refuse other than the normal once a week curb-side pickup. The special district rates are: Once a week on premise $ 3.80 6. That the monthly charge for refuse collection is a mandatory charge for service whether or not the service is utilized by the individual or commercial establishment. 7. That commercial refuse shall be collected at least once per week and oftener by agreement with the customer. That the following rates shall apply to special pickups of refuse: a. One dump truck with driver: $22.80/hour, assessed portal to portal plus $5.70/hour for one extra man, plus dump charges of $5.70 per dump. Maximum charge shall be for one hour plus a dump charge of $5.70. b. Drag-on box service shall be charged at the rate of $51.30 per box, with a dump charge of $5.70 per dump. Demurrage charges on drag-on boxes shall be $1.70 per day in the event the drag-on box is not dumped a minimum of one time a week. c. Special pickups of items such as water heaters, washers, dryers, etc. shall be individually negotiated at a reasonable rate between collectorand customer. Before any pickup of such items is made, customer shall be notified of charges. 9. That all rates established hereby shall be effective on January 1, 1974. 10. Collector shall pick up all trash other than that store in bins or drag-on boxes, if it is stored in cans no greater than 20 pounds, and a loaded weight of no greater than 60 pounds. Collector shall collect all crating, paper, cardboard, and trim- mings which are bundled and tied in four (4) foot lengths. 11. Collector shall not pick up any trash which is smolder- ing or burning. 12. Collector shall provide each of his customers with a written set of trash collection rules and rates. I 13. No person shall engage in the refuse collection busines within the City limits of the City of Carlsbad without a contract ~ 1 therefor from the City. 14. PASSED, APPROVED, AND ADOPTED at a regular meeting of the City Council of the City of Carlsbad, California, held on the 4th day of December , 1973, by the following vote, to wit: AYES: Cmn.
