HomeMy WebLinkAbout1973-12-18; City Council; Resolution 3299RESOLUTION NO. 3299 1 2 3 4' 5 7 8 9 10 11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADOPTING A MASTER PLAN FOR 52.5 ACRES OF LAND, LOCATED EASTERLY OF AND ADJACENT TO EL CAMINO REAL, SOUTHERLY OF THE PRESENT SOUTHERLY MOST EXTENSION OF TRIESTE DRIVE, TO ALLOM DEVELOPMENT OF A SINGLE FAMILY - SUBDIVISION BY APIOS SOMMERS. - WHEREAS, the Planning Commission of the City of Carlsbad did on the 27th of November, 1973, hold a duly advertised public hearing as prescribed by law, to consider a request by Amos Sommers for approval of a Master Plan to allow development of a s-ingle- family subdivision on property described as: 21 22 23 24 25 26 27 28 29 12 13 14 15 16 17 18 19 20 public hearinq held by the Planning Commission and the City Council and was approved as presented; and WHEREAS, on the __-- 18th day of December - , 1973, a duly advertised public hearing was held before the City Council to consider the proposed Master Plan, and after hearinq and consider- ing the testimony and arguments, if any, of all persons desiring to be heard, said Council did find the following facts and reasons present which in their opinion are necessary to carry out the general purpose of Title 21 of the Carlsbad Municipal Code: That portion of the West Half of Section 21, Township 12 South, Range 4 West, San Bernardino Base and Meridian in the County of San Diego, State of California. WHEREAS, at the conclusion of said hearing, the Planning Commission adopted Resolution No. 1013 recommending adoption of said Master Plan which is incorporated by reference herein; and WHEREAS, the applicant has met the requirementsof the "City of Carlsbad Environmental Protection Ordinance of 1972". An Envi ronmental Impact Report was filed and discussed at a duly noticed 2. The provision of a lesser density on that portion of the subject property with the greater terrain difference seents appropriate. 6 7 8 9 10 11 12 13 14 15 3. The size and location of the subject property is considered adequate for the ultimate development of 257 dwelling units. City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the findings of the Planning Commission contained in the Resolution No. 1013 constitute the findings of the Carlsbad City Council. 3. That the approval 0.f the proposed !laster Plan is necessary to carry out the general purpose of Title 21 of the Municipal Code. 4. That the Plaster Plan detailed in Planning Commission Resolution No. 1013 is hereby approved subject to all the conditions NOW, THEREFORE, BE IT RESOLVED by the City Council of the 29 30 31 32 (seal) 16 17 18 19 20 21 set out in said resolution. PASSED, APPROVED AND ADOPTED at a regular meeting of the January , 1974, by Cit,y Council on the _l_-l 15th day of __I________. the following vote, to wit: AYES : Councilmen Dunne, McComas, Lewis, Chase and Frazee.
