HomeMy WebLinkAbout1974-01-15; City Council; Resolution 33001 2 3 4' 5 6l 7 RESOLUTION NO. 3300 --__ 8 9 WHEREAS, a duly advertised Public Hearing was held on A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING FINDINGS AND DECISION AND ADOPTING SPECIFIC PLAN (SP-143) TO ALLOW THE DEVELOPMENT OF A 146-LOT SINGLE FAMILY SUBDIVISION ON APPROXIMATELY 52.5 ACRES OF LAND GENERALLY LOCATED EASTERLY OF AND ADJACENT TO EL CAMINO REAL, SOUTHERLY OF THE PRESENT SOUTHERLY MOST EXTENSION OF TRIESTE DRIVE. APPLICANT: AMOS SOMMERS 10 11 12 13 November 27, 1973, before the Carlsbad City Planning Commission in the manner prescribed by law to consider Specific Plan (SP-143) to allow for the development of 146 single family subdivision lots on 52.5 acres of property described as: 14 15 16 17 ' That portion of the West Half of Sectjon 21, Township 12 South, Range 4 West, San Bernardino Base and Meridian in the County of San Diego, State of California. 18 l9 0 2o 21 22 23 24 25 26 27 28 29 30 31. 32 k WHEREAS, at the conclusion of said hearing, said Commission adopted Resolution No. 1012, which is herewith referred to and made a part hereof recommending the approval with conditions of said plan; and WHEREAS, on the 18th day of December , 1973, the City Council held a duly advertised Public Hearing and received all recommendatioins and heard all persons interested in or oppose to the proposed Specific Plan; and WHEREAS, said Specific Plan has complied with the require- ments of the "City of Carlsbad Environmental Protection Ordinance of 1972" and an Environmental Impact Report was presented and discussed at a duly noticed public hearing held by the Planning Commission and the City Council and was approved as presented; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, as follows: A. That Specific Plan (SP-143) is thereby approved, subject to the execution and/or fulfillment of the following conditions: 1. The Specific Plan is granted for the land described in the application and any attachments thereto, and as shown on the plot plan submitted labeled Exhibits A & E. The location of all buildings, fences, signs, roadways, parking areas, landscaping, and other facilities or features shall be located substantially as shown on the plot plan labeled Exhibits A & E. The grading of the proposed development shall substantially conform to the cross-sections labeled Exhibits By C and D. 2. The architecture of the proposed development shall be compatible to the Hispanic character of the Histori- cal Corridor along El Camino Real. Prior to the issuance of any building permits, detailed building elevations shall be submitted to the Planning Depart- ment for consideration and approval. 3. Unless the construction of the structure or facility is commenced not later than one year after the date the approval is granted and is diligently pursued thereafter, this approval will automatically become null and void. 4. Any minor change may be approved by the Planning Director. Any substantial change will require the filing of an application for an amendment to be con- sidered by the Planning Commission. 5. All requirements of any law, ordinance or regula- tion of the State of California, City of Carlsbad, and any other governmental entity shall be compl ied with. 6. No signs or advertising of any type whatsoever shall be erected or installed until plans therefore have been approved by the City of Carlsbad. 7. Prior to obtaining a building permit and within thirty (30) days hereof, the applicant shall file with the Secretary of the Planning Commission written acceptance of the conditions stated herein. 8. Compliance with and execution of all conditions listed hereon shall be necessary, unless otherwise specified, prior to obtaining final building inspection clearance. Deviation from this requirement shall be permitted only by written consent of the Planning Director. 9. The developer is encouraged to work with the School District to insure that adequate schools will be available when needed. C.
