HomeMy WebLinkAbout1974-01-15; City Council; Resolution 3337c 2c 21 22 22 24 2: 2c 27 2e 29 3( 31 3; k 0 RESOLUTION NO. 3337 F THE 1 A RESOLUTION OF THE CITY COUNCIL TY OF CARLSBAD, CALIFORNIA EXPRESSING SUPPORT FOR THE PASSAGE OF SECTION 202(c) OF 52589 IN THE UNITED STATES SENATE, LIMITING MANAGEMENT OF PARKING SUPPLY AND PARKING SURCHARGES WHEREAS, the City Attorney's office has reviewed S2589, the "Energy Emergency Act", which includes sections which restrict regulations promulgated by the Clean Air Act of 1970; and WHEREAS, the regulations promulgated by the Environmental Protection Agency, and enumerated in part below, would impose a severe and unjustified burden upon the City of Carlsbad and its citizens, 1. The regulation of building of new commercial parking lots above certain sizes only with direct EPA approval; 2. The regulations imposing a surcharge upon free commer- cial parking provided by both the City and private industry; 3. The regulations requiring employers, including the Cit) to assess their employees sums of money for the use of what had prc viously been free parking; 4. The regulations which purport to supersede local land use regulations adopted by the City of Carlsbad, rendering them null and void in the event they conflict with the federal regula- tions; and , WHEREAS, Section 202(c) of S2589, if enacted by the United States Senate, would effectively preclude the enforcement of the EPA regulations which detrimentally affect both the City of Carlsbad and its citizens, as well as rendering moot current legal activities commenced against the EPA, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Carlsbad does hereby urge the adoption of Section 202(( of S2589, limiting parking surcharges, the management of parking 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 supply and preferential bus/carpool lane regulations, by the United States Senate. BE IT FURTHER RESOLVED that the City Clerk of the City of Carlsbad be, and she is hereby authorized and directed to forward a certified copy of this resolution to members of Congress repre- senting San Diego County voters. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 15th day of January, 1974, by the following vote, to wit: AYES : Councilmen Dunne, McComass Lewis, Chase and Frazee NOES : None.
