HomeMy WebLinkAbout1974-01-15; City Council; Resolution 3338J 2( t V 2: 2: 2; 24 2: 2t 2: 21 2s 3( 31 3; RESOLUTION NO, 3338 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING A CONDITIONAL USE PERMIT FOR A RESIDENTIAL CARE FACILITY FOR DEVELOPMENTALLY DISABLED ADULTS ON PROPERTY GENERALLY LOCATED ON THE WEST SIDE OF EL CAMINO REAL SOUTHERLY OF KELLY DRIVE, COMMONLY KNOWN AS THUNDERBIRD RANCH e WHEREAS, the Planning Commission of the City of Carlsbad did on October 9, 1973 hold a duly noticed public hearing to con- sider the application of Alfonso Filipponi for a Conditional Use Permit for a residential care facility for developmentally dis- abled adults on property generally located on the west side of El Camino Real southerly of Kelly Drive, and more particularly de- scribed as That portion of Lot "I" of Rancho Agua Hedionda, County of San Diego, State of California, accord- ing to Partition Map thereof No. 823, filed in the office of the County Recorder of San Diego County, November 16, 1896; and WHEREAS, the subject application is in compliance with the City of Carlsbad Environmental Protection Ordinance of 1972 in that it has been determined that it does not involve significant environmental effects ; and WHEREAS, at the conclusion of said hearing the Planning Commission, after making certain findings, determined to grant the permit subject to fourteen conditions; and WHEREAS, the applicant filed an appeal with the City Counci of the determination of the Planning Commission seeking relief fron one of said conditions; and WHEREAS, the City Council at their meeting of November 20, 1973 held a public hearing to consider the appeal and determined to refer the matter back to the Planning Commission for modifica- tion of the challenged condition regarding the necessity for fencing; and 4 I 1 1 . I 4 ! 1( 1: 1: 11 2c 21 22 2: 24 25 26 27 28 29 3c 33 32 b G WHEREAS, the Planning Commission has reported to the Council their concurrence with the modification of the fencing condition, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, as follows: 1. That the above recitations are true and correct. 2. That the Conditional Use Permit CUP-91 is granted for the reasons set out in Planning Commission Resolution No. 978 which is incorporated herein by reference- 3. That the permit is granted subject to all conditions of Planning Commission Resolution No. 978, except for said condi- tion No. 14 regarding fencing which shall be required in accordance with the following: A six-foot mesh fence shall be constructed by the applicant prior to occupancy to separate his property from adjoining properties along the boundary of Lots 4, 7, 8, 9, 10 and 11. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 15th day of January, 1974, by the following vote, to wit: AYES: Councilmen Dunne, r(cCotna$, Lewis, and Frazee. 4TTEST : r?
