HomeMy WebLinkAbout1974-03-12; City Council; Resolution 3377RESOLUTION NO. 3377 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, RECITING HELD IN SAID CITY OF CARLSBAD OM TIIE 5th DAY 9F MAfiCII, 1974, DECLARING THE RESULT THEREOF AND SUCH OTHER i4ATIERS AS ARE PROVIDED BY LAN. THE FACT OF TifE GENERAL ?4IINICIPAL ELECTION LJHEREAS, a regular general municipal election was held and conducted in the City of Carlsbad, County of San Diego, State of California, on Tuesday, the 5th day of March, 1374, as required by law; and NHEREAS, notice of said election was duly and regularly given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects said election was held and conducted and the votes cast thereat, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in cities; and WHEREAS, pursuant to Resolution No. 3366 adopted the 27th day of February, 1974, the City Clerk of the City of Carlsbad canvassed the returns of said election and has certified the results to this City Council, said results are received, attached and made a part hereof as "Exhibit A." NOIJ, THEREFORE, THE CITY COUNCIL 9F THE CITY OF CARLSBAD, CALIFORNIA, DOES RESOLVE AS FOLLONS: ~ SECTION ---- 1. lhat there were 15 voting precincts established for the purpose of holding said election consisting of consolidations of the regular election precincts in the City of Carlsbad as established for the holding of state and county elections. --l_l_-- SECTION 2. SECTION 3. That at said regular general municipal election, the following measure was submitted to the electors of said City, to wit: C OM MU N I T Y S W I PlM I NG PO 0 L P RO P 0 S I T I 0 N : Shall the City Council of the City of Carlsbad, California, view with favor a proposal that the City proceed with the construction and financing of a conimunity swimming pool at a cost estimated not to exceed $500,000.00? I_ SECTION 4. That the whole number of votes cast in said City (except absent voter ballots) was 4131. That the whole number of absent voter ballots cast in said City was 94, making a total of 4275 votes cast in said City. -__ -- - SECTION 5. That the names of persons voted for at said election for Mayor of the said City are as follows: ROBERT C. FRAZEE ROBERT B. PRESCOTT ANTHONY J. SKOTNICKI That the naines of persons voted for at said election for Member of the City Council of said City are as follows: CLAUDE A. LEWIS DAVID F. DAWES -2- 211 election for City Clerk of said City are as follows: MARGARET E. ADAMS 41 5 That the names of the persons voted for at said I election for City Treasurer of said City are as follows: il 7 8 9 FRANK C. RICE JOHN J. MAMAUX That the measure voted upon at said election is as follows: 10 11 12 13 14 15 /I COF4MUNITY SWIMMING POOL PROPOSITION: Shall the City Council of the City of Carlsbad, California, view with favor a proposal that the City proceed with the construction and financing of a community swimming pool at a cost estimated not to exceed $500,000.00? That the number of votes given at each precinct and the number of votes given in the City to each of such persons above named for the respective offices for which said persons 11 were candidates and for and against the measure were as listed 18 19 20 21 22 23 24 26 27 28 29 30 31 32 in Exhibit "A" attached. --I_ SECTION 6. The City Council does declare and determine that: ROBERT C. FRAZEE was elected Mayor of said City for the full term of four years; CLAUDE A. LEWIS was elected as Member of the City Council of said City for the full term of four years; MARGARET E. ADAMS was elected City Clerk of said City for the full term of four years; FRANK C. RICE was elected City Treasurer of said City for the full term of four years; That as a result of said election, a majority of the qualified voters voting on said measure relating to COMMUNITY SWIMMING POOL PROPOSITION did vote in favor thereof, and that said proposition was carried, and shall be deemed adopted and ratified. SECTION 7. The City Clerk shall enter on the ~ records of the City Council of said City, a statement of the result of said election, showing: -3- (1) The whole number of votes cast in the city; (2) The names of the persons voted for; 81 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 (3) The measures voted upon; (4) For what office each person was voted for; I SECTION 8. That the City Clerk shall immediately make and, upon compliance by the persons elected with the provisions of Section 11550 and Section 11559 of the Elections Code of the State of California, shall deliver to each of such persons so elected a Certificate of Election signed by her and duly authenticated; that she shall also administer to each person elected, the Oath of Office prescribed in the State Constitution of the State of California and shall have them subscribe thereto and file the same in her office. Whereupon, each and all of said persons so elected shall be inducted into the respective office to which they have been elected. I SECTION _L- 9. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted. ADAMS, City Clerk of the City of Carlsbad, County of San Diego, State of California, duly authorized by Resolution No. 3366, adopted by the City Council of said City on the 27th day of February, 1974, do hereby certify that I have canvassed the returns of the regular general municipal election held in said city on the 5th day of March, 1974, and find that the number of votes given at each precinct and the number of votes given in the City to persons voted for, the respective offices for which said persons were candidates were as described in the attached EXHIBIT "A".
