APPLICANT: DR. LOIS J. SMART, WHEREAS, on the 26th day of March, 1974, the Carlsbad :ity Planning Commission adopted Resolution No. 1053 recommending 20 the City Council that Tentative Map (CT 74-1) be denied; and WHEREAS, the City Council of the City of Carlsbad, on the 16th day of April , 1974, considered the recommendation >f the Planning Commission and requested that the proposed condo- ninium conversion be returned to the Planning Commission for :heir recommendation on conditions for approval; and WHEREAS, on the 23rd day of April, 1974, the Carlsbad :ity Planning Commission recommended that nine conditions be included in the proposed condominium conversion; and WHEREAS, said Tentative Map has been declared to be exempt from the requirements of the City of Carlsbad Environmental Pro- :ection Ordinance of 1972; NOW, THEREFORE, BE IT RESOLVED by the City Council of the :ity of Carlsbad as follows: A. That the above recitations are true and correct. B. That Tentative Map (CT 74-1) is hereby approved, sub- iect to the execution and/or fulfillment of the following condition: 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to a11 the requirements, limitations and restrictions of a11 municipal ordinances and state and federal statutes now in force, or which, hereafter, may be in force for the purpose of preserving the residential characteristics of adjacent properties. 2. The CC&R’s for this development shall be submitted to the Planning Director for review and approval prior to the issuance of any building permits. prior to City Council approval of the final map. 3. All public improvements shall be made in conformit) to the City of Carlsbad Engineering Design Criteria and Standard Plans, the Subdivision Ordinance and other City standards, to the satisfaction of the City Engineer, without cost to the City of Carlsbad, and free of all liens and encumbrances. sewer systems shall meet the requirements of the respective service districts.
