WHEREAS, on April 12, 1974, Interinsurance Exchange of the Automobile Club of Southern California as subrogee of Joe I,. Lovvorn filed a claim against the City of Carlsbad in the amount of $139.85; and WHEREAS, state law requires that the City Council consider all claims and take action to approve, approve in part, or deny said claim; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the City Council has heard and considered the facts and circumstances of the above-described claim. 3. That the City Council hereby denies said claim. 4. That the City Attorney is directed to forward a copy of this resolution to the claimant and to the City's insurance carrier. and to comply with all other notice requirements provided by law. GARDINER, Deputy City Clerk (SEAL) I 32 Contract No. 2011-e AGREEMENT THIS AGREEMENT made and entered into this day of 9 19 -’ at Sacramento, California, by and between DEPARTMENT OF FINANCE of the State of California, hereinafter called the Department, and the City of G.rt8bad hereinafter called the City: WITNESSETH: WHEREAS, it is provided in Section 2107.2, Streets and Highways Code, that any city or city and county may apply to Department to enumerate its population or the population of any inhabited territory annexed to the city subsequent to the last federal census, and WHEREAS, said Section 2107.2 provides that Department may make the enumeration if in the opinion of Department there is available ad- equate information upon which to base the enumeration, and WHEREAS, City desires to have Department enumerate population of City and Department is willing to make such enumeration, provided adequate information is available upon which to base the enumeration, NOW, THEREFORE, it is hereby mutually agreed between the parties hereto as follows: 1. City shall provide such data as are requested by Department in order that Department may determine whether adequate information is available upon which to base an enumeration of population. However, should Department deter- mine that adequate information upon which to base an enmeration of popula- tion can be developed Department agrees to proceed to perform such further work as it deems necessary in order to make an enumeration of population and if requested to do so by City, Department shall file a certified copy thereof with the Controller pursuant to Section 2107.2, Srreets and Highways Code. It is further mutually understood and agreed that Department shall have full and complete charge in the selection and application of the meth- od or methods used in enumerating the population of City and that City shall certify as to the accuracy of all information furnished from local records for use in preparation of said enumeration of population. 2. If City is unable to provide adequate information upon which to base an enumeration, the Department, at the request of Cfty, may provide addi- tional service directed toward the development of data for population enu- merating. Such service may include the design of procedures and provision of materials and data processing services for enumeration work carried out under the administrative guidance of and at the expense of City.
