The Council hereby expresses its intent to initiate pro- ceedings for the formation of an underground utility district for the above-described area to be known as Underground Utility Distric 2E 3( 3: 3: RESOLUTION NO. 3452 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CAL I FORN IA , EXPRESS I NG 1 TS I NTENT TO IN IT IATE PROCEED I NGS PURSUANT TO CHAPTER 1 1.08 OF THE CARLSBAD MUNICIPAL CODE AND CALLING A PUBLIC HEARING TO DETERMINE WHETHER THE PUBLIC HEALTH, SAFETY, OR WELFARE REQU I RE THE FORMAT I ON OF AN UNDERGROUND UTILITY DISTRICT ON EL CAMINO REAL FROM SOUTHERLY OF AGUA HEDIONDA CREEK TO RANCHO CARLSBAD 'DR I VE. WHEREAS, Chapter 11.08 of the Carlsbad Municipal Code provides 'or the formation in the City of Carlsbad of underground utility listricts to accomplish the orderly removal of existing overhead 'acilities and the construction of new underground facilities; and WHEREAS, the San Diego County Underground Advisory Committee ias recommended that contiguous City and County districts be formed to replace overhead lines on a portion of El Camino Real; 3 nd WHEREAS, The City Underground Advisory Committee has reviewed the proposed districts and concurs with the recommendation of the :ounty Underground Advisory Committee that a district be formed 3n El Camino Real from southerly of Agua Hedionda Creek to Rancho :arlsbad Drive; and WHEREAS, the monies for the work are to be charged to the 2ounty's allocation of conversion funds; and WHEREAS, further proceedings pursuant to Chapter 11.08 are darranted to determine whether or not the district should be of Carlsbad, as follows: No. 5, 2. NOTICE IS HEREBY GIVEN that a public hearing will be held by the Council of the City of Carlsbad on August 20, 1974, at the hour of 7:30 P.M. in the Council Chambers of the City Hall, 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Carlsbad, Cal ifornia, to ascertain whether the pub1 ic health, safety, or welfare require the removal of poles, overhead wires, and associated overhead structures, and the underground instal lati of wires and facilities for supplying electric, communication, or similar associated service in the area hereinabove described and to determine whether or not the City should continue proceedings to create and implement an underground uti 1 ity district to accomp- lish said removal and installation. 3. At said hearing all persons interested are invited to appear and present their views and all such persons shall be given an opportunity to be heard. Said hearing may be continued from time to time as may be determined by the City Council. 4. The area to be included within the proposed District No. 5 is shown upon that certain map entitled “Map of Proposed Underground Utilities District No. 5,” dated July 1, 1974 which is on file in the office of the City Clerk of the City of Carlsbad, and which is incorporated by reference herein. 5. The City Clerk shall give notice of the time and place of the hearing to all property owners within the District as shown on the last equal ized assessment rol Is or as known to the City Clerk and to each Public Utility within the District by mail- ing a copy of this resolution to such property owners and such utilities at leastten (10) days prior to the date thereof. PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council on the 16th day of Ju1.y , 1974, by the following vote, to wit: AYES : NOES : None.
