HomeMy WebLinkAbout1974-07-17; City Council; Resolution 34671 2 3 4 5 6 7 8 9 10 11 12 13 20 21 22 23 24 25 26 27 28 29 30 31 32 t 0 RESOLUTION NO. 3467 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADOPTING A FINAL OPERATING BUDGET FOR THE FISCAL YEAR 1974-75 FOR THE CITY OF CARLSBAD AND ESTABLISHING CONTROLS ON CHANGES IN APPROPRIATIONS FOR THE VARIOUS DEPART- MENTS AND FUNDS. BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: SECTION 1. That certain document now on file in the office of the City Clerk of the City of Carlsbad entitled “City of Carlsbad Preliminary Budget Fiscal Year 1974-75“ as amended in accord with Exhibits A, B, C and D attached hereto and incorpor- ated by reference herein shall be and the same is hereby adopted as the final operating budget for the City of Carlsbad for the fiscal year 1974-75. Said document is hereby referred to and by this reference made a part hereof. SECTION 2. That the amount designated as Department Total for each department and each fund in said document is hereby appropriated to the department or fund for which it is designated, and such appropriation shall be neither increasedmr decreased except as provided herein without approval of the City Council. All amounts designated as Personnel Services, Material, Supply, Services, and Capital Outlay in said document are hereby appro- priated for such uses to the department or fund under which they are listed subject to the controls herein. SECTION 3. That the City Manager may approve the transfer of amounts designated as Personnel Services, Material, Supply, and Services from account to account within any particular fund or Department Total. The City Manager may approve the transfer of funds from amounts designated as Personnel Services, Material, Supply, and Services to a capital account within any particular fund or department total an amount up to $500.00. 1 2 3 4 5 6 7 8 9 10 11 12 13 a 14 20 c - u 21 22 23 24 25 26 27 28 29 30 31 32 C pit SECTION 4. That the City Manager is authorized to approve 1 expenditures for particular budgeted items of $2,500.00 or less. Any such expenditure of more than $2,500.00 shall require the approval of the City Council. The City Manager may approve a transfer of funds from item to item or account to account within the total of any Department's Capital Outlay accounts in an amount up to $500.00. The City Manager may approve capital expenditures for a nonbudgeted capital item in an amount of $500.00 or less in connection with a fund transfer within the total of any Department', Capital Outlay account. Any changes so approved shall be reported to the City Council. SECTION 5. That the City Manager is authorized to transfei amounts from the Reserve Balance to the Personnel Services Account of any particular department and thereby increase the Department Total when such transfers are necessitated by City Council approvec adjustments to the interim salary plan for fiscal year 1974-75 as adopted by Resolution No. 3444 as amended by Resolution No.3452, adjourned PASSED, APPROVED AND ADOPTED atan/regular meeting of the City Council on the 17th day of July , 1974, by the follow- ing vote, to wit: AYES: Councilmen Frazee, Chase, McComas, Lewis and Skotnick NOES: None ABSENT: None ATTEST : T E. 8 2"' &2"/ ADAMS, Ctty Clerk (SEAL) 2. EXHIBIT 'A' FIRST SUPPLEMENT TO INTERIM PARKS AGREEMENT DATED OCTOBER 15, 1973 BEmEN THE CITY OF CARLSBAD AND LA COSTA LAND COMPANY This First Supplement to Interim Parks Agreement made this 18th day of July , 1974, by and between THE CITY OF CARLSBAD, a municipal corporation under the laws of the State of California (hereinafter called "City") and LA COSTA LAND COiWANY, an Illinois corporation (herein- after called "La Costa") ; W I T N E S S E T H: WHEREAS, La Costa and City entered into an interim parks agreement dated October 15, 1973, to provide for the scheduling of the dedication of the Master Plan Parks in connection with the La Costa Master Plan development and to clarify the procedure for accomplishing the dedication of San Marcos Canyon in accord w Ordinance No. 9322; and - .- - - ._ - - _- WHEREAS, La Costa is desirous of modifying the schedule for the accomplishment of the dedication of por- tions of San Marcos Canyon; and WHEREAS, City is agreeable to accommodate La Costa ir- said regard and at the same time further clarify the procedure for accomplishing the complete dedication of the Canyon, including a comprehensive survey at the expense of La Costa in order to fix the Canyon's boundaries; NOW, THEREFORE, in consideration of the mutual promises and obligations of the parties it is agreed as follows: 1. Section 1 of the Agreement dated October 15, 1973, between the City of Carlsbad and La Costa Land Company for interim park arrangements is amended to read as follows: ''1. La Costa, in lieu of awaiting releases of that portion of the La Costa Master Plan area denoted as "San Marcos Canyon", as provided in Ordinance 9322 which adopted . . . ._._ .. said plan, shall dedicate the Canyon as hereinafter provided: (a) Those portions of the Canyon adjacent to the boundaries of the subdivision known as La Costa Vale If and I11 and ranging down to a midpoint at the bottom of the Canyon shall be surveyed and the acreage contained therein certified by a licensed civil engineer and deeded or dedi- cated to the City by December 31, 1974. such slope right and other easements on the boundaries of said Canyon as necessary to develop the adjacent property and as agreeable to the City. La Costa may reserve (b) La Costa shall immediately undertake to survey the boundaries of all portions of the Canyon as shown on the Master Plan as adopted by Ordinance 9322 znd not previously dedicated. The survey shall be certified by a licensed civil engineer and shall be accomplished to the satisfaction of the City Engineer. Said survey shall be completed and delivered to the City Manager for submission to the City Council for approval by December 31, 1974. Upon approval it shall fix the boundaries of the Canyon for purposes of accomplishing the dedication of the Canyon in accord with Ordinance 9322 and this agreement. (c) Prior to the approval of any final map for property adjacent to the Canyon and as a condition precedent to such approval La Costa shall survey those portions of the Canyon adjacent to the subject map down to a midpoint at the bottom of the Canyon, and the acreage contained therein shall be certified by a licensed civil engineer and shall be deeded or dedicated to the City of Carlsbad. a Costa may reserve such slope right and o-ther easements on the bowadaries of said Canyon as necessary to develop the adjacent property and as agreeable to the City."
