RESOLUTION NO. 3504
A RESOLUTION OF THE CITY COUNCIL F THE
CITY OF CARLSBAD, CALIFORNIA, AMENDING
THE PRECISE PLAN FOR PALOMAR PARK FREEWAY
SERVICE FACILITIES ADOPTED BY RESOLUTION
NO. 1327 BY DELETING THEREFROM THE PROP-
ERTY GENERALLY LOCATED AT THE NORTHEAST
CORNER OF THE INTERSECTION OF PALOMAR
AIRPORT ROAD AND AVENIDA ENCINAS NORTH.
WHEREAS, the City Council by Resolution No. 1327 adopted
a precise plan for Palomar Park freeway service facilities for
property generally located on the northwesterly and southeasterly
corners of Interstate 5 and Palomar Airport Road; said resolution
is incorporated by reference herein; and
WHEREAS, I\hmicipal Code now provides that service stations
be processed with a conditional use permit; and
WHEREAS, the Planning Commission has granted a permit for
a diesel fuel sales and tire service facility for a portion of
the project covered by said plan generally located on the north-
easterly corner of the intersection of Palomar Airport Road and
Avenida Encinas North, more particularly described on Exhibit B
to Resolution No. 1327; and
WEEREAS, the Planning Commission by Resolution No. 1081
has recommended that the portion of the precise plan which overlaps
the property covered by the conditional use permit be rescinded;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the precise plan for Palomar Park freeway service
facilities as adopted by Resolution No. 1327 is hereby amended to
delete therefrom the property described on Exhibit B to said
resolution.
PASSED, APPROVED AND ADOPTED at a resular meeting of the
Carlsbad City Council held on the -- 3rd day of September, 1974,
