RESOLUTION NO. 3542
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, EXPRESSING
THE INTENTION OF THE CITY COUNCIL TO
APPROVE AN AMENDMENT TO CONTRACT BETWEEN
THE BOARD OF ADMINISTRATION OF THE PUBLIC
EMPLOYEES' RETIREMENT SYSTEM AND THE CITY
OF CARLSBAD. -
WHEREAS, the Public Employees' Retirement Law permits
rticipation of public agencies and their employees in the
Public Employees' Retirement System by the execution of a contract
and sets forth the procedure by which said public agencies may
elect to subject themselves and their employees to amendments to
said law; and
WHEREAS, one of the steps required in the procedure to
amend this contract is the adoption by the legislative body of
the public agency of a resolution giving notice of its intention
to approve an amendment to said contract, which resolution shall
contain a summary of the changes proposed in said contract; and
WHEREAS, the following is a summary of the proposed
change :
Provides, upon death of a local safety member who has
retired for service or disability for the continuation of post-
retirement survivor allowance to certain survivors.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That it does hereby give notice of intention to
approve an amendment to contract between said City of Carlsbad
and the Board of Administration of the Public Employees' Retire-
ment System. A copy of said amendment is attached as Exhibit A
and incorporated herein by reference.

REIMWRSEMENT AGREEmPTT
THIS AGIIEEiWNT, entered into this 20th day of August, 1974,

by and between the County of San Diego, a political subdivision
of the State of California, hereinafter referred to as "County1',
and the City of Carlsbad, hereinafter referred to as "City.. I!
WITNESSETH:
WHEREAS, a total $41,593.00 has been approved by the Cali-
. fornia Department of youth Authority from supplemental funds
provided by the passage of AB 180 of the 1974 Regular Session
for use by the Carlsbad Police Juvenile Diversion Project for
the term of September 1, 1974 to August 31, 19'75; and
WHEREAS, said funds are to be disbursed to the Chief Probation
Officer of San Diego County, who in turn is to disburse funds to
the Carlsbad Police Juvenile Diversion Project;
NOW, THEREFORE, the Chief Probation Officer of the County of
San Diego agrees to disburse on a quarterly basis to the City of
Carlsbad funds to be spent on the Carlsbad Police Juvenile Diver-
sion Project, not to exceed the amount of $41,593.00, in consfdem-
tion,for the. City of Carlsbad advancing said sums for use by the
Carlsbad Po1.i c e Juvenile Diversion Project -
The City of Carlsbad and the Carlsbad Police Juvenile Diversion
Project further agree and certify that all funds spent on said pro-
ject shall be expended in accordance with the program and budget
approved by the Department of Youth Authority and in accordance
wi-th thp standards as set forth by said agency.
In the event City claim and receives payment from
County for a service, reimbursement for which is later dis-
allowed to the County by the State of California or the United,
Skates Government under a related agreement providing for
County sponsorship of the program covered by this agreement,
the City shall promptly refund the disallowed amount to -\
the County on request, or at its option, the County offset the
amount disallowed from any payments due or to become due to
City under the agreement.
IN WITNESS WHEREOF, the aftersigned parties do hereby
