HomeMy WebLinkAbout1974-12-03; City Council; Resolution 35511 n 14 2( t 0 21 2; 2: 24 2: 2t 2'; 2E 25 3c 33 32 RESOLUTION NO. 3551 ..-I- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ANNOUNCING FINDINGS AND DECISION ON A PREANNEXATION CHANGE OF ZONE FROM SAN DIEGO COUNTY E-1-A TO RD-M (RESIDENTIAL DENSITY- MULTIPLE Z0NE)AND C-1 (NEIGHBORHOOD COMMERCIAL ZONE) ON 16.5 ACRES TO ALLOW CONSTRUCTION OF A NEIGHBORHOOD COMMERCIAL AND APARTMENT COMPLEX ON PROPERTY LOCATED AT THE NORTHEAST CORNER OF ALGA ROAD AND EL CAMINO REAL. APPLICANT: CAL PACIFIC PROPERTIES. WHEREAS, on October 22, 1974 a duly advertised public hearing was held before the Planning Commission in the manner prescribed by law to consider a preannexation change of zone from San Diego County E-1-A to RD-M (residential density-multiple zone) and C-1 (neighborhood commercial zone) as shown on the map marked ZC-149, Exhibit A, dated October 8, 1974, on file in the Planning Department and incorporated by reference herein, on property lo- cated at the northeast corner of Alga Road and El Camino Real, more particularly described as: Parcel B - A 4.978-acre parcel in San Diego County located in the West one-half of the Northeast one- fourth of Section 26, Township 12 South, Range 4 West (to be zoned RD-M) . Parcel C - A 5.500-acre parcel in San Diego County located in the West one-half of the Northeast one- fourth of Section 26, Township 12 South, Range 4 West, (to be zoned RD-M) . Parcel D - A 6.001-acre parcel in San Diego County located in the West one-half of the Northeast one- fourth of Section 26, Township 12 South, Range 4 West- (to be zoned C-1). WHEREAS, at the conclusion of said hearing the Planning Commission of the City of Carlsbad adopted Resolution No. 1106 recommending said zone change which is herewith referred to and made a part hereof; and WHEREAS, on the 19th day of November, 1974, the City Council held a public hearing on the matter, received all recom- mendations and heard all persons interested in or opposed to the proposed change of zone: and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 9 0 2c 21 22 2: 24 25 2€ 27 2E 2s 3c 33 32 WHEREAS, the Planning Director has determined that said change of zone will have a nonsignificant impact on the environ- ment and a negative declaration has been prepared and filed in satisfaction of the requirements of the City of Carlsbad Environ- mental Protection Ordinance of 1972 and the California Environment a1 Quality Act; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the findings of the Planning Commission contained in the aforementioned Resolution No. 1106 constitute the findings of the Carlsbad City Council. 3. That the approval of the proposed preannexation change of zone classification is necessary to carry out the general pur- pose of Title 21 of the Municipal Code. 4. That the City Council of the City of Carlsbad intends to adopt an ordinance to effectuate the proposed preannexation change of zone. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 3rd day of December , 1974, by the following vote, to wit: -_- AYES: Councilmen Frazee, Chase, Lewis, McComas and Skotnick.
